If you opt to join the union, and consent, a service fee will be paid through direct payroll deduction.AREA OF CONSIDERATION: Open to the PublicDESCRIPTION OF DUTIES:The Juvenile Section handles most juvenile prosecutions in the District of Columbia. The Section has jurisdiction to charge a juvenile for any criminal offense under the DC Code, Federal Code, or DC Municipal Regulations. Section attorneys work closely with other juvenile justice stakeholders to make appropriate charging decisions, to interact with victims and witnesses, to evaluate appropriate dispositions for involved juveniles, and to litigate appropriate cases in the Superior Court's Family Division.MAJOR DUTIES AND RESPONSIBILITIES:Incumbent reviews information presented and relevant case law to determine whether a proceeding or filing should be initiated. Reviews for this purpose include interviewing agency officials, other potential witnesses, available documents and sources of information.Incumbent is responsible for preparing complaints, responses, motions, legal briefs/memoranda as appropriate.Prepares and conducts litigation including preparation of witnesses and exhibits; collection and organization of evidence; preparation and conduct of preliminary proceedings; identification, procurement and preparation of expert services; examination of witnesses; and oral arguments.Performs extensive legal research; prepares detailed memoranda of findings to support conclusion of cases in accord with judicial and office policies, procedures and precedents; informs supervisor of findings of facts and resolution of assigned cases.Negotiates resolution of cases and determines, with the approval of the supervisor, when continued proceedings are no longer in the best interest of the District of Columbia and prepares documentation and necessary court papers to implement negotiations.Performs all functions related to case and calendar management, such as pretrial, motion and trial scheduling, preparation of case transfer or close-out reports, case file entry updating, documentation of action taken or orders issued, timely preparation and service of fillings, timely issuance of subpoenas, and any other administrative function associated with litigation.Iincumbent is responsible for keeping abreast of judicial, agency, and other changes in laws and regulations related to the function of programs and the recommendation of appropriate courses of action to the Office of the Attorney General (OAG).Incumbent may have to confer with and incorporate the concerns of District Government officials, members of administrative bodies, and officials outside of the District Government with actions taken during enforcement cases.Incumbent represents OAG in complex hearings and prepares evidence, briefs, motions, and other documents to support cases, as necessary.Incumbent keeps abreast of judicial, agency and other changes in laws and regulations related to the function of programs and recommends appropriate courses of action to the Division Deputy Attorney General, the Chief Deputy Attorney General and the Attorney General.Incumbent ensures staff is trained in laws, rules, regulations, adjudicative process, and in gathering information and documentation to provide supporting evidence pursuant to enforcement or corrective actions.Incumbent compiles monthly statistical and status reports on cases assigned.Incumbent performs other duties as assigned.KNOWLEDGE REQUIRED BY THE POSITION:Extensive knowledge of applicable District and Federal laws, regulations, guidelines, principles, practices and techniques, including agency policies and relevant judicial decision.Substantial skills in the analysis and resolution of difficult legal issues in an orderly, systematic, and effective mannerSkills in interpreting and applying laws, regulations and practices, including agency policies and relevant judicial decision.Skills in identifying and isolating controlling legal issues from complex factual situations.Skills in applying and isolating judgment in the review and analysis of matters and deriving logical conclusions.Knowledge of legal reference materials and research techniques, including the use of Westlaw, LexisNexis, and other automated legal and legislative retrieval systems.Skills in communicating precisely and effectively, both orally in writing. Advanced knowledge of legal advocacy tactics and strategy as well as negotiation, pre-trial and trial techniques.SUPERVISORY CONTROLS:The incumbent works under the general supervision of the supervisor and in close coordination with the appropriate OAG manager and/or the Director. Assignments are on a continuing basis and much of the work is self-generated through recognition of compliance problems and/or proposals requiring study. Incumbent independently plans work and methods of approach, resolving most of the conflicts which arise. Incumbent coordinates work with others and consults with supervisor on policy matters and precedent-settings issues. Work is reviewed for feasibility and effectiveness in meeting objectives and requirements.GUIDELINES:Guidelines include applicable District and Federal statutes and regulations; Mayor's Orders; OAG policies, procedures, issuances, and directives; technical and administrative manuals, publications, textbooks and professional publications; applicable rules of administrative procedures; rules of local courts and administrative agencies; Acts of Congress and the Council of the District of Columbia; and established Office policies, practices, and procedures. Guidelines have broad applicability and the incumbent is expected to select, apply and deviate from traditional methods and practices, as required by the nature of the problem encountered. Originality is required in the development of legal and regulatory rationale on environmental issues in which there are no suitable precedents.COMPLEXITY:Work involves full legal administrative responsibilities related to diverse questions and problems in a variety of program areas. Assignments include drafting proposed legislation, revisions to codes and regulations, revisions to the civil infractions schedule of fines; policies and procedures for enforcement action; preparing memoranda of agreement with other District and Federal agencies, reviewing state delegation of authority applications, compliance orders, notices of non-compliance (similar to complaints), consent agreements, adjudication of environmental issues before the Office of Administrative Hearings; and, participation in national litigation and/or rulemaking. Work requires continuous efforts to establish, develop, and revise legislative requirements and enforcement actions to deal with unforeseen problems and obstacles.SCOPE AND EFFECT:The purpose of the work is to identify, isolate and define adverse programmatic and operational objectives; resolve intricate and complex problems; and plan, develop, and carry out legislative and administrative functions and procedures. The work directly affects OAG's reliability, attainment of established objectives, and compliance with specific District and Federal rules and laws.PERSONAL CONTACTS:Contacts include management and staff of the Office, judicial representatives, other attorneys, staff members of the Executive Office of the Mayor, staff members of the Council of the District of Columbia, members of the public, staff from Federal and other District agencies, procurement and fiscal officials and vendors.PURPOSE OF CONTACTS:Contacts generally involve litigating, collecting, obtaining or exchanging factual information related to assigned cases; advising concerned parties of court appearance dates; preparing witnesses regarding their role in court proceedings; securing expert advice to support evidence and other related data to be presented in litigation; advising interested agency personnel regarding the status of pending matters.PHYSICAL DEMANDS:Work is predominately sedentary; however, some walking, standing, bending and carrying light to moderately heavy objects (such as boxes of records, briefcases, and exhibits) are required.WORK ENVIRONMENT:The work is primarily performed in a typical office and courtroom setting.QUALIFICATIONS:The Incumbent must have a minimum of one (1) year of which must have been equivalent to LA-12. The candidate must have at least four (4) years of relevant related specialized experience.ELIGIBILITY:LICENSURE/CERTIFICATIONS:The successful candidate must have a law degree and be an active member in good standing of the bar of any jurisdiction. If not a member of the District of Columbia Bar, the candidate must be sworn into the District of Columbia Bar within 360 days of his/her initial appointment with the Office of the Attorney General for the District of Columbia.The selected candidate will be subject to a general background investigation, including reference checks.OTHER SIGNIFICANT FACTS:This position is designated as security sensitive for the Child Support Services Division only.Depending upon the Office and/or division, the incumbent of this position may have to make intermittent on-site visits where there is exposure to known toxic chemicals and/or industrial situations where environmental conditions cannot be controlled.
