Duties

  • Provide executive direction to labor attorneys who are experts in the Railway Labor Act. Communicate the Board's policies and priorities and allocate resources to accomplish a complex legal program including research, representation, and litigation.
  • Advise the Board on a wide range of legal issues; interpret the Railway Labor Act based on legislative history and precedent and render timely opinions on its application to matters before the Board, often under conditions of extreme pressure.
  • Manage a large caseload of representation cases assigned to subordinate staff, ensuring the development and execution of effective case management strategies and the meeting of customer service standards.
  • Ensure the production of high-quality representation decisions, as evidenced by impartiality, sound and persuasive reasoning. Maintain the agency's Representation Manual, routinely revising the manual to reflect current procedures and policies.
  • Manage the litigation program, overseeing the formation and preparation of the Board's position in lawsuits filed in Federal court by parties affected by its actions under the Act and acting as co-counsel with Department of Justice counsel.
  • Serve as a key member of the agency's senior management team, participating in agency budget and performance planning, organizational development, staff development, and development of overall direction and policies.
  • Ensure compliance with the Freedom of Information Act, the Government in the Sunshine Act, and other statutes and programs affecting the Board and its activities.
  • Supervise the Freedom of Information Act Officer Review and recommend proposed responses to both initial requests and appeals under the FOIA.
  • Serve as the Designated Agency Ethics Official and manage the Board?s ethics program.

Qualifications

Mandatory Qualifications:
In order to meet the minimum qualifications for the General Counsel position, individuals must:

1. Have an LL. B or J.D. degree or higher from a law school accredited by the American Bar Association (ABA).
2. Have been admitted to the Bar and be authorized to practice as an attorney under the laws of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.
3. Haveat least one year of progressively responsible executive level leadership experience and legal office management directly related to the skills and abilities described below. Experience of this nature will have been gained at or above the GS-15 grade level in the Federal service or its equivalent with State or local government, the private sector, or nongovernmental organizations.

To be considered, all applicants must address each of the Mandatory Technical Qualifications listed below in a narrative statement.

Technical Qualifications:


1.Demonstrated ability to apply knowledge of the Railway Labor Act to the operation of the agency tasked with enforcing it.
2.Demonstrated ability to interpret U.S. statutes, Executive Orders and regulations relating to railway labor law; and knowledge of laws and regulations applicable to the operation of a Federal Agency.
3.Demonstrated ability to serve effectively as a member of the Agency's executive leadership team in ensuring the Agency successfully fulfills its mission.
4. Demonstrated ability to manage a full-service legal organization engaged in the broad range of legal practice (i.e., operating the representation function of the agency, as well as providing legal advice to the mediation and arbitration mission areas of the agency; litigation; administrative law, including employment law; and providing legal advice to Agency executives and staff). Inherent in this qualification is the demonstrated ability to assess and prioritize client and organizational needs, and to develop a strategy to communicate, interpret, explain and advocate on complex legal matters which arise in the normal conduct of business.

Current or former Senior Executive Service members must submit documentation of their SES status and a narrative statement addressing only the Mandatory Technical Qualifications. Unless you are currently serving under a career SES appointment, or have successfully completed an SES Candidate Development Program, approved by the Office of Personnel Management (OPM), and been certified by OPM, you must also submit a narrative statement covering each of the Executive Core Qualifications.

Graduates of approved SES Candidate Development Programs must include a copy of their OPM certification of eligibility and a narrative statement addressing only the technical qualifications. Your examples should be clear and concise, and emphasize your level of responsibilities, scope and complexity of the programs managed, program accomplishments, including results of your actions, policy initiatives, and level of contacts. Each Technical Qualification and each ECQ, if required, must be addressed separately and include experience (paid and unpaid), education, training, awards, and/or self-development activities related to each. Education

Additional information

Telework Suitability:
The duties of this position are suitable for occasional telework and the selectee may be allowed to telework with supervisor approval and if they meet the eligibility criterion in the 2010 Telework Act.

Stipulations of Employment:
Selection may require completion of a 1-year supervisory or managerial probationary period.
