SUMMARY DESCRIPTION Senior Attorney will provide legal and policy support for CTFK's advocacy concerning FDA regulation of the tobacco industry under the Family Smoking Prevention and Tobacco Control Act (FSPTCA) and state and local tobacco control legislative efforts.A' This will include development and participation in litigation related to FDA regulation and the defense of state and local tobacco control laws.A' The incumbent will provide legal and policy guidance to CTFK staff as needed on federal, state and local issues.A' The position is based in Washington, DC and reports to the Vice President for Legal and Regulatory Affairs. All staff are currently working remotely with return to the DC office expected after March 1, 2022 under a Hybrid model.A' Full COVID-19 vaccinations requirements apply. PRIMARY DUTIES Working with other CTFK staff, ensure effective FDA regulatory activities to implement the FSPTCA. Develop and conduct litigation activities as necessary to ensure effective FDA regulation to implement the FSPTCA, including preparation of briefs and other court filings and related research and legal and policy analysis. Engage in legal representation of client groups and individuals in lawsuits concerning FDA regulatory activities, including participating in privileged, confidential communications with clients in such litigation. Participate in meetings, conference calls and other communications with CTFK public health partners and other groups to facilitate participation of those groups in litigation activities as necessary to ensure effective implementation of the FSPTCA. Interact with outside law firms, consultants, researchers and others as necessary to engage in litigation activities to ensure effective implementation of the FSPTCA. Prepare formal comments, letters and other submissions to FDA addressing policy and legal issues relating to FDA regulation under the FSPTCA and perform legal and policy research to inform those submissions. Participate in meetings, conference calls and other communications with CTFK public health partners and other groups to facilitate development of common positions re FDA regulatory issues and the submission of joint comments, letters and other communications to FDA. Interact with outside law firms, consultants, researchers and others to develop CTFK positions on FDA regulatory issues and inform formal comments, letters and other submissions to FDA on those issues. Develop in-depth knowledge and expertise on all aspects of FDA regulation under the FSPTCA and provide counsel and guidance to CTFK staff re same. Review draft legislative and communications material to ensure accuracy and clarity on legal and policy issues related to FDA regulation of tobacco. Monitor on-going FDA regulatory activities under the FSPTCA and identify opportunities for CTFK and partners to communicate their views to FDA concerning the legal and policy issues raised by those activities and opportunities to engage in litigation as necessary to ensure effective implementation of the FSPTCA. Engage in public education activities on legal and regulatory issues involving effective implementation of the FSPTCA, including participation in such activities at meetings, conferences, symposia, webinars and other venues and assisting in preparation of materials in support of such activities. Assist in development of material re CTFK's regulatory advocacy at FDA for Board meetings. Perform other functions, as required, to support CTFK activities to ensure effective FDA regulation to implement the FSPTCA. Working with other CTFK staff, provide legal and policy support on tobacco control issues at state and local level. Work with Campaign Advocacy staff to identify and evaluate opportunities to engage in litigation in support of state and local tobacco control laws and regulations, including the filing of briefs amicus curiae. Draft briefs amicus curiae in support of state and local tobacco control laws and regulations and interact with CTFK State Advocacy staff and outside groups to recruit other groups to join the briefs with CTFK. Assist in development of material for Board meetings re CTFK participation in litigation activities in support of state and local tobacco control laws and regulations. Provide legal and policy assistance in analysis of state and local legislation, including drafting legislative proposals as required. Work with CTFK State Advocacy staff to provide legal and policy assistance to state and local tobacco control advocates as needed. Conduct legal and other research to assist in development of, and advocacy for, policy positions. Review advocacy materials generated by other departments bearing on state and local tobacco control issues to ensure accuracy and clarity re legal and policy issues. Serve as resource for other CTFK staff on legal and policy issues relating to state and local tobacco control laws and regulations. In consultation with Finance & Administration personnel and outside counsel, research and provide guidance on compliance with state laws re lobbying and election-related activities. Perform other duties as directed by Vice President for Legal and Regulatory Affairs. A' REQUIREMENTS JD required. At least 6 years of legal experience, including predominately litigation experience. Well-developed skills in legal research and writing, particularly legal briefs. Skill in drafting and analyzing complex legislation. Well-developed skill in giving oral presentations on legal and policy issues in clear and concise fashion. Experience in translating legal concepts for multiple non-technical audiences. Experience in exercising sound judgment developing and implementing effective legal strategy and tactics. Engaging in litigation activity with minimal supervision.
