Duties

  • Conducts, coordinates, and manages the most complex, significant, and precedent setting enforcement matters involving insured financial institutions and their Institution-Affiliated Parties (IAPs), including Technology Service Providers (TSPs) and other third parties providing banking services.
  • Interprets and applies relevant case law, statutes, and regulatory provisions, and provides advice and counsel to executive management in the FDIC's Legal Division and operational divisions in connection with the development and implementation of FDIC policies, procedures, and positions related to the supervision, regulation, and enforcement of insured financial institutions and IAPs.
  • Prepares legal briefs, office memoranda, and other legal documents on complex or sensitive legal issues, including those (i) involving questions of first impression, (ii) with conflicting precedents, and (iii) that require extensive research of case law and legislative history.
  • Serves as the FDIC's attorney in administrative and civil enforcement proceedings, often involving complex issues, cases of first impression, or cases of important precedential value. Litigates such actions, in some cases as lead counsel. Drafts pleadings, briefs, motions, opinions, memoranda and correspondence. Independently drafts discovery requests including requests for electronically stored information (ESI),and responds to such requests on behalf of the FDIC. Utilizes E-discovery software applications such as Relativity and Clear well to identify, recover and organize relevant and responsive ESI. Prepares and examines witnesses.

Qualifications

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. CG-14:

To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the 13 grade level or above in the Federal service. Specialized experience is defined as providing legal advice and recommendations, conducting legal research, and preparing memoranda on the interpretation and enforceability of the Federal Deposit Insurance (FDI) Act and the rules and regulations and the handling of actions involving such laws, including civil or administrative enforcement actions at the direction and under the supervision of a supervisor or team lead.

CG-15:

To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the 14 grade level or above in the Federal service. Specialized experience is defined as providing legal advice and recommendations, conducting legal research, and preparing memoranda on the interpretation and enforceability of the Federal Deposit Insurance (FDI) Act and related rules and regulations and the handling of actions involving such laws, including civil or administrative enforcement actions or litigation.

Education

There is no substitution of education for the experience for this position.

Additional information

As required by Executive Order 14043, Federal employees are required to be fully vaccinated against COVID-19 regardless of the employee's duty location or work arrangement (e.g., telework, remote work, etc.), subject to such exceptions as required by law.
