Duties

Prepares advisory opinions on a variety of questions presented by the Special Agent in Charge (Washington), the Director of Industry Operations (Washington), and the Associate Chief Counsel (East Region). This requires the research and analysis of legal matters such as the seizure and forfeiture of property; offers in compromise; the issuance, suspension, and denial and revocation of licenses and permits; and violations of criminal provisions of Federal law relating to alcohol, tobacco, firearms and explosives. These assignments usually involve complicated facts and require the review and analysis of inspection reports or investigation reports and other documents submitted with the request for a legal opinion.

The Division Counsel serves as lead and/or assists the US Attorney with alcohol, tobacco, explosives and firearms related litigation. Reviews and analyzes investigation reports to determine whether or not the facts constitute violations of the law and regulations and to determine the procedure to be followed; and prepares a memorandum advising as to the action that should be taken on the case. If the case relates to permit or license matters that are adjudicated before administrative law judges or hearing officers, represents the Bureau at the hearing. On cases that are tried by the Department of Justice, such as criminal violation cases, the Attorney may, upon request of the U.S. Attorney, assist at the trial and settlement thereof.

Provides advice and recommendations to Bureau officials on a wide range of complex legal problems, including constitutional law issues, criminal law and procedure, administrative law and asset forfeiture.

This is a non-bargaining unit position.

Due to COVID-19, the agency is currently in an expanded telework posture. If selected, you may be expected to temporarily telework, even if your home is located outside the local commuting area. Once employees are permitted to return to the office, you will be expected to report to the duty station listed on this announcement.

MOBILITY PLAN : New employees hired pursuant to this vacancy announcement must sign a mobility agreement. Applicants must be an active member of the bar of any State or the District of Columbia, in accordance with Department of Justice policy.

Specialized Experience is experience which is in or directly related to the line of work of this position and which has equipped the applicant with particular knowledge, skills and abilities to successfully perform the duties of the position.

Specialized experience for this position includes:

GS: 15: Applicants must have in excess of six years commensurate with the duties and responsibilities of the position. The attorney also serves as lead attorney on extremely complex legal issues where there is little or no precedent. This includes cases referred to the office on alcohol, tobacco, firearms, explosives and arson matters, including litigation, as required. The specialized experience must be providing legal advice in connection to extensive understanding of all Federal laws, including the Federal firearms and explosive laws; as well as other federal regulations used by ATF.

The GS-15 salary range starts at $144.128.00 to $172,500.00 . If you are a new federal (civil service) employee, your starting salary will be set at the Step 1 for this position and the grade level for which you are selected.
