Duties

The incumbent serves as an Attorney Advisor within the Legal Policy Division (LPD) of PLPD. LPD provides legal advice and guidance on matters of PBGC policy, and serves as the primary office for providing legal advice on legislation and legislative activity, including the rules governing agency actions, as well as implementation of legislation.

As an Attorney Adviser in the Legal Policy Division of the Office of the General Counsel you will:
  • Analyze and interpret relevant provisions of the Employee Retirement Income Security Act (ERISA) and other statutes, such as the Bankruptcy Code or Internal Revenue Code, and of regulations of PBGC and other agencies.
  • Monitor legislative activity impacting PBGC and retirement security.
  • Advise on legislation, legislative activity, the implementation of legislation, and policy concerning PBGC and retirement security.
  • Develop, review, and coordinate review of legislative technical assistance, regulatory and policy guidance, and related reports and documents.
  • Draft guidance and other legal documents, including policy statements, that incorporate the views of appropriate PBGC officials.
  • Lead working groups representing various operational units and professional disciplines.
  • Coordinate and conduct legal and policy research and analyze significant legal issues stemming from statutory, regulatory, policy, and operational issues.
  • Participate in internal discussions on legal, policy, and program matters.
  • Represent PBGC in meetings and conferences with industry and practitioner groups on complex legal, regulatory, and policy issues.

  • Complete a Declaration for Federal Employment to determine your suitability for Federal employment, at the time requested by the agency

Qualifications

All qualification and eligibility requirements must be met by the announcement closing date.

You may start at GS-13 step 1, with an annual salary of $122,530.00, if you meet the following specialized experience by the closing date of the announcement (in addition to the education requirement).

Specialized experience is defined as as one year of experience at or equivalent to the GS-13 grade level in the Federal service identifying, developing, analyzing, and interpreting legal matters and policy or guidance relevant to ERISA. Examples may include experience working in General Law or Legal Policy identifying, analyzing, and interpreting provisions relevant to legal or policy issues related to ERISA. Candidates with judicial clerkship experience or law firm experience preferred.

All qualification requirements should be met by the closing date of the announcement.

Education

In order to qualify for this position, you must possess:

A J.D. degree from a school of law accredited by the American Bar Association.

Education must be completed at a College or University that has been accredited by an accrediting institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications.

In addition to the education requirement, you must currently be an active member and in good standing of the bar of a state, a territory of the United States, or of the District of Columbia.

WRITING SAMPLE: Each applicant must submit an original sample of their own written work that does not exceed ten pages in length (double or single spaced). The writing sample should demonstrate legal analysis.
