This position is in the National Office of the Employee Benefits Security Administration (EBSA) in Division of Health Investigations (DHI), Office of Enforcement (OE), located in Washington, DC.

The primary function of OE is the protection of pension, health and welfare benefits under Employee Retirement Income Security Act (ERISA) through the provision of a strong and effective national and field office enforcement program.

Major duties for this position include but are not limited to, the following:
  • Serves as an Advisor to the Division Chief and OE Senior Management regarding the planning, development, implementation, and evaluation of current and proposed goals, objectives, and strategies pertaining to the EBSA health enforcement program.
  • Formulates and recommends the implementation of the strategies, methodologies, targeting criteria, procedures, reporting and accountability systems, and guidance that form the basis for the National health enforcement program.
  • Assist the Division Chief and OE Senior Management with the evaluation of trends and patterns of health enforcement and litigation efforts carried out by EBSA and other Federal and State agencies as well as private litigation in the area of employee benefit and analyzes resulting court decisions.
  • Develops written guidance and training materials that address issues such as the criteria for initiating and carrying out health investigations, Federal and State legal and regulatory mandates, interpretation of court and administrative rulings as they pertain to the health enforcement of ERISA, the collection, maintenance, and disposal of evidentiary materials, procedures for referring cases for litigation, etc.
  • Guides the health enforcement program and may be called upon by Regional and National management and other senior Regional and National staff to provide investigative assistance, guidance, and technical expertise in the conduct of specific health investigations which involve possible civil violations.

Travel Required

Occasional travel - 5% of travel as needed.

Requires one (1) year of specialized experience equivalent to the GS-13 level in the Federal Service as defined below: Specialized experience is experience that has equipped the candidate with the particular knowledge, skills, and abilities, to perform successfully the duties of the position, and that is typically in or related to the work of the position to be filled. For this position, Specialized experience is defined as analyzing legal issues involving laws such as Employee Retirement Income Security Act (ERISA), Health Insurance Portability Accountability Act (HIPAA), Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA) and other similar health laws, polices and regulations; applying civil investigative techniques; and providing technical guidance, reviewing and evaluating ERISA covered health plans and a variety of other health and insurance products and vehicles.
