Summary

This position is located in the Office of Management Services, Division of Regulatory and Policy Coordination. The incumbent in this position is responsible for the regulatory program, information collection, Freedom of Information Act (FOIA) release of records, and Privacy Act. This position reports to the Director, Division of Regulatory and Policy Coordination.

Responsibilities

    Regulatory Program: Provide professional, technical, and administrative guidance to Indian Health Service Program Office Directors and staff on regulatory activities. Responsible for identifying and coordinating Federal Register material of concerns to Indian Health Service Program Offices. Prepare and review various regulation-related documents and submit Indian Health Service comments to Health and Human Services to the impact on agency programs. Pre-paralegal analysis and implications to the Indian Health Service on proposed rulemaking regulations and other regulatory issues. Information Collection: Assist in administering, implementing, and monitoring the Indian Health Service Paperwork Reduction Act/Office of Management and Budget (PRA/OMB) information collection requirements and procedures, and obtains Office of Management and Budget approvals and extensions for the Indian Health Service information collection. Assists in preparing required reports and review proposed Indian Health Service surveys and other information collection projects to ensure they meet Federal and Indian Health service requirements. Freedom of Information Act (FOIA) Release of Records: Review documents to determine whether they are/are not subject to withholding under the Freedom of Information Act. Prepare all documentation, communications and releases of documents that are not subject to withholding under the Freedom of Information Act. Serve as the official Indian Health Service contact for requesters, attorneys, and Area Freedom of Information Act coordinators and keeps the Indian Health Service Freedom of Information Act and Privacy Act Officers apprised of any difficulties. Incident Response: Assist the Privacy Officer to properly investigate, report, and advise management on follow-up actions, with the Department Computer Security Incidence Response Committee, Indian Health Service Incidence Response Team (OIT), and the Area Health Insurance Portability and Accountability Act (HIPAA) Coordinators on any Health Information Technology for Economic and Clinical Health Act (HITECH) Breach Incidents, involving improper transmission of Protected Health Information (PHI) and Protected Individually Identifiers (PII) to resolve the breaches timely.

Qualifications

To qualify for this position, your resume must state sufficient experience and/or education, to perform the duties of the specific position for which you are applying.

In addition to the Basic Requirements, you must also meet the Minimum Qualifications stated below.

MINIMUM QUALIFICATIONS:
Your resume must demonstrate at least one (1) year of specialized experience equivalent to at least the next lower grade level in the Federal service obtained in either the private or public sector performing the following type of work and/or tasks: Serving as a comprehensive advisor for the legal analysis, review and submission of regulations, advising the Agency on the Paperwork Reduction Act (PRA) and compliance with the Act, expertise on the Freedom of Information Act (FOIA), and providing guidance on the Privacy Act (PA). Developing and editing draft documents, such as proposed and final rules, and supplementary regulations. Researching, analyzing and responding to complex matters for FOIA requests, Information Collections and Privacy incidents. Preparing and reviewing various regulation-related documents, such as notices, information collection submissions, and analysis of regulations that could impact agency programs. Planning and tracking projects in numerous stages and sensitivities. Communicating with the public on FOIA, and other regulatory compliance issues. Monitoring compliance with Federal laws and advising, training, and assisting the Agency in all functional areas related to regulatory compliances, Freedom of Information Act (FOIA), Privacy Act (PA) and Paperwork Reduction Act (PRA).

Time In Grade
Federal employees in the competitive service are also subject to the Time-In-Grade Requirements: Merit Promotion (status) candidates must have completed one year of service at the next lower grade level. Time-In-Grade provisions do not apply under the Excepted Service Examining Plan (ESEP).

Federal Employees earn annual leave at a rate (4, 6 or 8 hours per pay period) which is based on the number of years they have served as a Federal employee. IHS may offer newly-appointed Federal employees credit for their directly related previous non-federal experience or active duty uniformed military service. This credited service can be used in determining the rate at which they earn annual leave.

This position is covered by a Bargaining Unit.
