Responsibilities

The Employee Benefits, Exempt Organizations and Employment Taxes (EEE) Division serves multiple operating divisions and covers a wide array of topic areas including employee benefits, exempt organizations, employment taxes, state and local governments, and Indian tribal governments.As a key member of the senior executive staff of the Office of Chief Counsel, the Deputy Associate Chief Counsel, Employee Benefits (EB) is responsible for assisting with the coordination and direction of all guidance activities and certain other matters related to those technical areas; and provides legal advisory services that support uniform interpretation, application, enforcement, and litigation of tax laws involving employee benefits. The character of the work and its relation to the operations of the IRS requires the highest degree of coordination and liaison with the other Associate and Division Counsel and with the TE/GE Business Operating Division, as well as the Office of Benefits Tax Counsel under the Assistant Secretary of the Treasury (Tax Policy).

MAJOR DUTIES AND RESPONSIBILITIES:

The incumbent acts as principal legal advisor to the ACC Employee Benefits, Exempt Organizations, and Employment Taxes (EEE) and, the Chief Counsel, Deputies Chief Counsel, and other Chief Counsel and IRS executives in matters relating to employee plans, executive compensation, and health and welfare benefits.

Through several Branch Chiefs, the incumbent exercises executive direction over a staff of about 40-50 personnel engaged in:
  • Preparing and reviewing proposed regulations and Treasury Decisions, considering public comments on proposed regulations, conducting public hearings on proposed regulations, and managing the movement of regulations through the review process in Counsel, the IRS and Treasury;
  • Participating in the legislative process, furnishing advice and assistance with respect to the development of proposed legislation, coordinating recommendations for legislation with Treasury officials, and working with Treasury and the legislative staffs in drafting legislation and committee reports;
  • Drafting revenue rulings, revenue procedures, notices, and announcements, to be published for the guidance of taxpayers and IRS personnel;
  • Issuing technical advice memoranda and responding to questions raised by IRS examiners;
  • Issuing private letter rulings and general technical information letters in response to requests from taxpayers;
  • Preparing legal opinions for other Chief Counsel and IRS functions with respect to legal questions raised in litigation and IRS programs.

Qualifications

As a basic requirement, candidates must clearly describe progressively responsible leadership experiences that demonstrate the executive level managerial capabilities comprising the Executive Core Qualifications (ECQs) of the Senior Executive Service. Typically, experience of this nature will have been gained at or above the GS-15 grade level or its equivalent in Federal service or with state or local government, the private sector, or non-governmental organizations.

The following five ECQs provide the focus for the Office of Personnel Management certification of executive qualifications for initial career appointment to the Senior Executive Service. The listing of elements for each activity area is illustrative, not exhaustive.

A) Executive Core Qualifications (ECQs):

Unless you are currently serving under a Career Senior Executive Service (SES) appointment, are eligible for reinstatement into the SES, you must address the ECQs. The following five ECQs provide the focus for certification of executive qualifications for initial career appointment to the Senior Executive Service and also provide a basis for assessing relative quality of management experience for this position. The listing of elements for each activity area is illustrative, not exhaustive, and it is not expected that an individual will be a subject-matter expert in all of these activities. Please provide a brief explanation providing two examples of your experience with each ECQ.

  • B) Professional/Technical Competencies (PTCs):

    In addition to the general managerial competencies set out in the Executive Core Qualifications and mandatory for all Senior Executive Service positions, candidates must show evidence of the following more specific competencies in order to meet basic qualifications for this position:

    Mandatory:
  • Position requires comprehensive, professional knowledge of and experience in applying tax laws affecting one of more of the following areas: (1) employee plans; (2) executive compensation; or (3) health and welfare benefits.
  • Must have demonstrated experience in managing all aspects of a large-scale law program that involves significant human and fiscal resources. Experience includes planning, directing, budgeting for, staffing, and evaluating such programs, as well as the ability to plan, direct, and coordinate all of the legal work within the designated area of responsibility.
  • Must have demonstrated the ability to review and evaluate programs to measure effectiveness against overall goals and objectives and to assess effectiveness against overall goals and objectives and to assess the need for and implement program improvements to increase efficiency.
  • Must have demonstrated the capacity for effective and decisive decision-making, as well as the ability to solve problems of substantial impact, sensitivity, and complexity.
  • The ability to effectively manage the Chief Counsel's EEO Program within the designated area of responsibility is necessary.

  • Desirable
  • A thorough understanding of the operations and organization of the Internal Revenue Service and Office of Chief Counsel, and a solid understanding of the Department of the Treasury and its Office of General Counsel, are desirable.

    Education

    Applicants must possess a J.D. and have one year of general legal experience plus three years of professional legal tax experience. An LL.M. in Taxation is desired but not required.

    The experience may have been gained in the public or private sector, or through Volunteer Service . One year of experience refers to full-time work; part-time work is considered on a prorated basis.
