The United Mine Workers of America Health and Retirement Funds (the Funds) has an immediate opening for an entry-level attorney with 0-3 years of employee benefit and health plan experience. The Funds is a group of six multiemployer plans that provide health and pension benefits primarily to retired coal miners and their eligible dependents.
The Associate Counsel will be responsible for providing legal advice to the Funds’ Trustees and staff regarding all aspects of administering an employee benefit plan. Duties include, but are not limited to, the following:
- Researching legal issues and drafting memoranda regarding compliance with related statutes such as ERISA, Internal Revenue Code, HIPAA, Affordable Care Act, Bankruptcy code, SMCRA, Coal Industry Retiree Health Benefits Act and NLRA.
- Reviewing and providing advice on participants’ eligibility for benefits under the various plan documents and in accordance with the organization’s established procedures.
- Drafting, reviewing, and interpreting contracts and other legal documents.
- Representing the organization in litigation in federal courts.
Candidates should possess superior analytical and writing skills, be self-motivated and detail-oriented. A basic knowledge of ERISA, employee benefit plan and trust documents, and bankruptcy law is preferred. Candidates must possess a law degree (J.D.) plus up to three years related experience and/or training. Bar admission is required.
