Summary

The Associate General Counsel (AGC) is a core member of the Office of the General Counsel's (OGC) senior leadership team, is a primary advisor to the General Counsel (GC) and Deputy GC, and heads one of two legal divisions: Compensation or Merit Systems. The AGC oversees significant matters at the request of the GC or Deputy GC and represents the office when the GC and Deputy GC are unavailable and may be called upon to take on additional responsibilities as needed. Responsibilities

  • Supervises the provision of advice and assistance concerning the rules and guidance established by OPM for other agencies on a host of complex matters affecting the Federal workforce;
  • Supervises advice on matters involving OPM and its employees, including for example, procurements, contract administration, appropriations law, and, through an interdivisional team, ethics;
  • Supervises representation of the agency in administrative litigation concerning Governmentwide matters, including the administration of Federal workforce compensation and benefit programs;
  • Supervises representation of the agency in administrative litigation concerning internal personnel matters;
  • Oversees the coordination of litigation support to the Department of Justice when matters affecting programs concerning the Federal workforce arise in or are appealed to the Federal courts;
  • Assists the General Counsel and Deputy General Counsel in responding to Justice inquiries concerning how best to frame particular arguments that implicate statutes OPM administers and whether to seek further review in particular matters;
  • Arranges representation with Justice?s Torts Branch when current or former OPM officers or employees require representation;
  • Makes recommendations to the General Counsel and Deputy General Counsel concerning retirement matters before the Merit Systems Protection Board;
  • Manages and sets the strategic director for Compensation and Merit Systems divisions:
  • Oversees legal issues and matters pertaining to Federal employee benefits, compensation, leave, retirement, health/life insurance, ethics, debt collection, and torts;
  • Oversees legal issues and matters pertaining to SES issues, procurement matters, appropriations law, garnishment of Federal pay and related administrative litigation;
  • Oversees legal issues and administrative law matters in areas of staffing; governmentwide suitability, fitness, credentialing programs and internal national security program;
  • Oversees legal issues and administrative law matters pertaining to performance; EEO; Hatch Act administration and ethics, reduction in force, and the Administrative Law Judge program; and
  • Handles related administrative litigation, plus adverse and performance-based actions, grievance and arbitration, suitability appeals, internal and government-wide labor relations, collective bargaining, FOIA and Privacy Act appeals.

Qualifications

To meet the minimum qualifications for this position, you must have earned a professional law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association, be an active member of a Bar in good standing, and you must possess all of the mandatory Executive Core Qualifications listed below. These qualifications would typically be acquired through education, experience, and training which reflect progressive development and achievement in managing a comprehensive program in a complex organization. An individual's total experience and education must demonstrate the ability to perform the duties of the position. Applicants must meet all of the qualification requirements by the closing date of this announcement.

The Executive Core Qualifications are required for entry to the Senior Executive Service; to meet the minimum qualification requirements for this position, you must show in your resume that you possess the five Executive Core Qualifications (ECQs) listed below:

  • Salary for Senior Executive Service positions varies depending on qualifications
  • Selected candidate will be subject to a one-year probationary period in the Senior Executive Service unless required probationary period has previously been served
  • Selected candidate is required to file a SF-278, Public Financial Disclosure Report within 30 days after his/her appointment, in accordance with the Ethics in Government Act of 1978
  • Veteran's Preference does not apply to the Senior Executive Service

You will be evaluated for this job based on how well you meet the qualifications above.

You will be evaluated on the quality and extent of your total accomplishments, experience, and education. Resumes will be evaluated by a rating and ranking panel, and highly qualified candidates may be invited to participate in a structured interview and undergo a reference check. The OPM Executive Resources Board (ERB) will review results and make recommendations on final selections to the approving authority.

Unless you have already been certified by a Qualifications Review Board (QRB) in the past, your ECQs must be certified by a QRB before appointment can occur.
