Summary

This position is located in the Legal Division, Supervision, Legislation & Enforcement Branch, Bank Activities & Regional Affairs Section, Bank Activities Unit, of the Federal Deposit Insurance Corporation and provides support in the areas of providing legal advice and counsel on all open bank legal matters.

Responsibilities

  • Prepares legal briefs, office memoranda and other legal documents on complex, sensitive legal issues, including those involving questions of first impression and with strongly conflicting precedents, which require extensive research, analyses and ingenuity to resolve.
  • Represents, with appropriate supervision, the views of the Legal Division with top management officials in the FDIC and with top management officials of other organizations, and delivers speeches, lectures and training sessions both within and outside the FDIC.
  • Works closely with staff members in the other government agencies, including the Federal Reserve Board and Banks, the Office of the Comptroller of the Currency, the Department of Justice, and state banking departments.
  • Performs specialized and complex policy-oriented legal work relating to the FDIC's supervisory and regulatory functions, with particular emphasis on the development of regulations, legislation, and FDIC legal/supervisory policy guidance, and the interpretation and application of the statutes and regulations governing the activities, operations, and structure of financial institutions.
  • Prepares legal advisory opinions and develops recommendations in response to questions and issues raised by insured financial institutions, bankers, financial institution counsel, members of Congress, financial institution depositors and customers, relating to the interpretation of Federal Deposit Insurance Act ("FDI Act"), Federal banking, securities, and derivatives laws and regulations, andvarious statutes and regulations governing the activities, operations, and structure of open operating
    financial institutions.

Qualifications

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g. Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic, religious spiritual; community; student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. To qualify, applicants must have completed at least one year of specialized experience equivalent to at least the13 grade level or above in the Federal service. Specialized experience is defined as conducting legal research and analyses for, and providing legal advice to, senior management and/or senior policymakers, including drafting legal opinions/legal documents related to the interpretation of Federal Deposit Insurance Act, or other banking or financial institution laws.

  • Skill in drafting memoranda, legal opinions, and pleadings, and performing research. Ability to prepare a great variety of pleadings, motions, briefs and other legal documents.
  • Ability to analyze litigation issues, to dispassionately consider legal issues, and to propose solutions, which deal affirmatively with problems, presented.
  • Ability to provide, with appropriate supervision, senior management officials and policymakers, as well as Congressional representatives of other agencies and other policy officials, authoritative legal analyses, advice, and provide guidance on the controversial, and precedent-setting issues.
  • Knowledge of the Federal Deposit Insurance Act, the Dodd-Frank Wall Street Reform and Consumer Protection Act, and implementing regulations. Knowledge of legislation and financial institution regulatory laws to generate and apply new rulemakings, opinions, and legal policy to issues.
  • Skill in effectively researching, analyzing and resolving legal issues and to communicate such matters clearly and logically in written presentations, with appropriate recommendations.
