Senior Director, Associate General Counsel for Enterprise Regulatory

The Enterprise Regulatory Advisory Team in Capital One's Legal Department is seeking an experienced attorney to be the enterprise-wide legal expert on the Fair Credit Reporting Act (FCRA), the nationwide and specialty Consumer Reporting Agencies (CRAs), the Servicemembers Civil Relief Act (SCRA), the Military Lending Act (MLA), and related laws generally. The attorney in this position will be primarily responsible for legal interpretations and advice to numerous business-critical initiatives and processes at Capital One. Given Capital One's status as a national bank and unique position as one of the largest providers of consumer and small business credit and other financial services, the areas of law for which this attorney is the primary legal advisor directly impact a large volume of high priority initiatives and work streams impacting hundreds of millions of customers and consumers. These subject matter areas are foundational and significantly impact a majority of Capital One's products and services.

This role also requires an experienced and strong people leader responsible for managing a small team of Capital One legal professionals, including other attorneys. This position will entail numerous interactions with business and staff partners, Legal Department subject matter experts and senior line of business attorneys in a fast-paced environment.

This position will report to the Managing Vice President - Chief Counsel, Consumer Regulatory and will have responsibility for:
  • Being the enterprise-wide legal subject matter expert on the:
    • Fair Credit Reporting Act (FCRA) including the FACT Act, Regulation V, and related state laws
    • Nationwide and specialty Consumer Reporting Agencies (CRAs), including permissible purpose representations, relevant reporting and disputes standards and systems (e.g., Metro2, eOSCAR, ACDV)
    • Servicemembers Civil Relief Act (SCRA), and related state laws
    • Military Lending Act (MLA), and related state laws
  • Owning, updating, and interpreting relevant legal requirements in PRIME
  • Being a people leader responsible for managing a small team of Capital One legal professionals, including other attorneys
  • Oversight for other areas of law handled by other associates on team, including Bankruptcy, Sworn Documents, and Internal Garnishments


The successful candidate will have the following:
  • Proven track record of building collegial and effective relationships (including attorneys, business managers, analysts, project managers, and Corporate Compliance professionals), influencing and inspiring trust from colleagues and clients, exercising excellent judgment, and appropriately escalating issues in a timely way.
  • Strong analytical skills and understanding of complex data
  • Ability to provide innovative solutions and well-grounded advice that balance regulatory risks and business needs - particularly in situations where the law is unclear
  • Ability to clearly identify and describe legal risks presented and offer assessment and mitigating options
  • Ability to prioritize a significant volume of time sensitive requests and to manage multiple, simultaneous deadlines


Basic Qualifications:
  • Juris Doctor from an accredited law school
  • Active member in good standing of at least one state bar
  • At least 10 years of law firm, in-house legal department, federal regulatory agency experience, or a combination
  • At least 5 years years of experience in financial services or consumer financial protection


Preferred Qualifications:
  • 7+ years of experience advising on consumer finance laws, regulations and disclosures
  • 3+ years of experience advising on Fair Credit Reporting Act (FCRA), Credit Bureaus
  • 3+ years experience advising on Servicemembers Civil Relief Act (SCRA), Military Lending Act, and benefits or protections
  • 3+ years of people management experience
  • 2+ years of experience advising national banks
  • 2+ years of experience advising on credit card or auto lending
