Summary

This position is located in the Office of the General Counsel, Division of Legal Counsel, FOIA Branch. The FOIA Branch handles all FOIA requests and appeals processing for the General Counsel-side and the Board-side offices at the NLRB. The incumbent will serve as Deputy to the FOIA Branch Chief and provide assistance within the full scope of managerial responsibility for activities to ensure efficient coordination and management regarding legal, administrative, and personnel matters.

Responsibilities

The selectee of this position is responsible for performing the following duties:
  • Conducting presentations for Agency staff, and/or parties external to the Agency involving problems or issues of considerable importance in FOIA matters;
  • Preparing and/or reviewing FOIA determinations, appeals, and drafts of the Agency's annual FOIA reports to the Department of Justice, as well as other statutorily-required FOIA reports and internal Agency reports;
  • Completing case supervision and multiple tasks efficiently to achieve applicable metrics;
  • Providing expert legal and technical guidance regarding the application of controlling statutes, regulations, case law, and procedures pertaining to the FOIA;
  • Hearing and resolving employee complaints, effecting minor disciplinary measures, and recommending action in serious causes; and
  • Other duties that may be assigned.

IDEAL CANDIDATE STATEMENT


The Ideal Candidate for the Supervisory Attorney-Advisor (Deputy Branch Chief) position will have experience providing advice and assistance regarding complex Freedom of Information Act (FOIA) matters or NLRA matters, expert knowledge either processing or supervising the handling of cases or requests for records electronically, experience completing case supervision and multiple tasks efficiently to achieve applicable metrics, and experience dealing with personnel and human resources concerns. Excellent communication, interpersonal skills to interact with colleagues and senior level management, strong research, writing, and analytical skills are desired.

MINIMUM QUALIFICATIONS

Applicant must have one year of specialized experience equivalent to the GS-14 grade level that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the GS-15, Supervisory Attorney-Advisor (FOIA) (Deputy Branch Chief), and that is typically related to the work of the position to be filled. Specialized experience includes:
  • Experience providing expert legal and technical guidance regarding the application of regulations, case law, and procedures pertaining either to FOIA for the purpose of disclosing records, or to the NLRA for purposes of supervising the case handling of unfair labor practice and representation cases;
  • Experience writing and reviewing clear and concise agency determinations, appeals, correspondence, memoranda, and reports that are accurate, objective, and complete for the purpose of transmitting information concerning FOIA disclosures, legal matters, and/or performance metrics; and
  • Experience providing advice, counsel, or instructions on administrative and human resources management to assure efficient coordination of administrative and personnel matters.

BAR MEMBERSHIP AND CERTIFICATION

Applicants must be an active member of the Bar in good standing of any state, District of Columbia, Puerto Rico, or any Territorial court under the US constitution.

Your active BAR license must reference BAR number and indicate the status of good standing.


Education

An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LL.B or JD).

(NOTE: Current NLRB Attorneys may not be required to submit a copy of their transcripts. However, NLRB employees within 3 years from receiving their juris doctorate degree, must provide a transcript with their application package.)


Education must be accredited by an accredited institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications (particularly positions with a positive education requirement).
