Summary

This position is located in the Department of Homeland Security (DHS), Office of the General Counsel (OGC), General Law Division (GLD).

The primary purpose of this position is to serve the Office of the General Counsel as the Assistant General Counsel for Policy, Oversight and Specialized Acquisition.

Responsibilities

As a Supervisory Attorney-Advisor (General) GS 0905 15, your typical work assignments may include the following:
  • Supervise and manage assigned counsel who support the Office of the Chief Procurement Officer, the Office of Program Accountability and Risk Management, the Department Suspension and Debarment Official, the Office of Selective Acquisitions, and the Federal Protective Service Acquisition Division.
  • Review acquisition and procurement documents for clarity and legal sufficiency, and advise source selection teams/members.
  • Participate in negotiations on behalf of DHS and review contract awards for compliance with law and regulation in both a classified and unclassified environment.
  • Provide oral and written advice on all post-award contract matters in both a classified and unclassified environment.
  • Represent DHS in contract appeals filed before the Civilian Board of Contract Appeals (CBCA), and assist the Department of Justice when appeals are filed before the United States Court of Federal Claims or the Court of Appeals for the Federal Circuit. Litigation may be classified or unclassified.
  • Represent DHS in bid protest actions. Assist the Department of Justice when bid protests are filed before the United States Court of Federal Claims or the Court of Appeals for the Federal Circuit. The bid protests may be classified or unclassified.
  • Research and analyze applicable laws and regulations, provide interpretations of those laws and regulations to the DHS General Counsel and other DHS officials.
  • Review DHS procurement and acquisition policies and directives, regulations, correspondence and other issues for legal sufficiency, and make recommendations regarding necessary changes to those issuances.
  • Attend meetings as required in support of the Program Accountability and Risk Management efforts and review associated documentation.
  • Advise the Suspension and Debarment Official on proposed suspensions and debarment actions. Actions may include fact-based suspension and debarments as well as actions based on criminal indictments.
  • Perform other duties as assigned.

Qualifications

Basic Requirements:
You must be an active member in good standing of the bar of the highest court of a State, U.S. Commonwealth, U.S. Territory, the District of Columbia, or the Commonwealth of Puerto Rico, and be a graduate of a law school accredited by the American Bar Association.
AND, meet the minimum qualifications as stated below:

GS-15:
1. The first professional law degree (LL.B. or JD); or
2. The second professional law degree (LL.M.) AND
3. Specialized professional legal experience in excess of three (3) years that is commensurate with the duties and responsibilities of the position. The quality of the individual's background may be evidenced by the relatedness of his or her specialization.

Specialized Experience:
The Office of the General Counsel (OGC) will evaluate eligible candidates based on the following criteria:
OGC will assess qualified applicants by comparing each candidate's qualifications to those pertinent to the position. OGC will consider relevant skills and experience, education and training, performance, and awards. The skills and experience listed immediately below are of particular importance to the position, and applicants should provide specific detailed information in these areas, where applicable, as part of their application.

For this position, specialized experience includes experience providing legal advice and support on matters related to acquisition and procurement issues. Experience is typically in or related to the work of the position as described in the Duties section above. APPLICANTS MUST HAVE AT LEAST FIVE (5) YEARS OF RELEVANT POST-JD EXPERIENCE.

As the Assistant General Counsel for Policy, Oversight and Specialized Acquisition, the individual selected for this position will supervise the attorneys who provide legal advice to the Office of the Chief Procurement Officer, Office of Program Accountability and Risk Management, the Department Suspension and Debarment Official, Office of Selective Acquisitions, and the Federal Protective Service Acquisition Division. In addition to performing the supervisory and management functions of the position, the attorney will address legal issues concerning the review of pre- and post-award contracting documents and actions for legal sufficiency and compliance with all aspects of contract law, regulations and decisional precedent, and provide substantive legal advice on a number of contract matters, including acquisition strategies, requirements, funding, solicitations, contract awards, clause interpretations, contract performance, enforcement actions, cancellations, and terminations in a classified and unclassified environment. Additionally, some contract litigation may be required. Counsel will also attend meetings as required in support of the Program Accountability and Risk Management efforts. Counsel with be directly supervised by the Deputy Associate General Counsel for Acquisition and Procurement Law.

Substitution of education in lieu of specialized experience may not be used for this grade level.

Current General Schedule (GS) federal employees, and those that have served in GS positions within the last 52 weeks, must have served 52 weeks at the next lower grade, or a combination of the next lower grade level and an equivalent band in the federal service.
All qualifications and eligibility requirements must be met by the closing date of the announcement.

Selectee may be required to serve a one-year supervisory probationary period.
Selectee will be required to complete an OGE 450, Confidential Financial Disclosure Form.
Permanent Change of Duty Station (PCS) Expenses will (not) be paid.
