Summary

The Contract Specialist , in the Management Bureau/Office of Acquisition and Assistance (M/OAA), is responsible for all pre-award and post-award functions involving highly complex negotiated procurements of significant importance to the agency. Requirements of the contracts, grants, cooperative agreements, inter-agency agreements are typically highly specialized and involve complex systems or sensitive international programs.

Responsibilities

Contract Specialists in M/OAA are responsible for all pre-award and post-award functions involving highly complex negotiated procurements of significant importance to the Agency. Requirements of the contracts, grants, cooperative agreements, inter-agency agreements are typically highly specialized and involve complex systems or sensitive international programs.

At this expert level, the Contract Specialist demonstrates comprehensive and expert understanding of the concepts and processes. Provides instruction and guidance to others, particularly mentorship to junior employees. Completes assignments and advises clients with limited involvement from supervisor. Conducts negotiations independently and advises supervisor of potential problems. Work products reflect a deep understanding of applicable policy and best practices.

At this level, the Contract Specialist should have received warrant authority or have completed required education, training and demonstrated experience to be eligible to receive a USAID warrant. Additionally, the Contract Specialist should demonstrate advanced proficiency in cost analysis/cost realism.

Analyzes Sources for the Items/Services Procured - 30%
  • Procures items or services for which adequate price competition is available. Prepares solicitation documents.
  • Performs detailed analysis of all elements of cost in contractor proposals. Determines the competitive range and prepares defensible justifications when required.
  • Participates in pre-proposal conferences with prospective contractors to arrive at a clear understanding of what is required under the proposed contract.
  • Obtains appropriate data from business and technical officials. Issues necessary modifications to clarify questions concerning such topics as specification changes, language ambiguities, or clarification of contract clauses or subcontracts.
  • Explores well established contracting approaches to arrive at an equitable contract arrangement. In the absence of meaningful cost and price information, pursues other approaches for gathering comparative data.

Monitors Contractor's Performance - 20%
  • Recommends actions when the contractor is not in compliance with contract provisions.
  • Investigates circumstances to determine and recommend alternative courses of action, such as extension of delivery schedule.
  • Conducts contract reviews to evaluate contractor's performance, and monitors contractor activity to assure compliance.
  • Monitors such matters as payments, claims, and contractual changes, to ensure requirements of the contract are met.
  • Reviews completed contract file, to ensure routine administrative matters are resolved or completed.
  • Performs work related to the termination of contracts for either convenience of the government or default of the contractor.

Contract Compliance Review - 20%
  • Advises technical office counterparts and contractors on their administration responsibilities contained in the contract.
  • Assists in the termination of contracts for the convenience of the Government or default by the contractor. Prepares all documentation necessary to support and defend termination decisions. Assists in negotiating termination claims.

Procurement Program Planning Work - 10%
  • Assists in the procurement planning activities for assigned organizations, which may include reviewing and clearing project papers and representing M/OAA at program planning meetings.
  • Serves as part of a team that develops objectives for the program in terms of competition and price range, and constructs the contractual or assistance vehicle, which includes the use of pricing arrangements, subcontracting policy, set-aside polices, and similar considerations.
  • Prepares and maintains current acquisition plans, appropriate milestone charts, and related schedules and keeps M/OAA management informed of anticipated workload demands or problems.
  • Determines and provides advice to project personnel on effective implementation and time frames required.
  • Advises program officials of the procurement instruments to be used and assists in the preparation of statements of work.
  • Provides training to new project/technical staff on USAID regulations and FAR requirements. Collaborates in the development of evaluation criteria.

Negotiates Procurement of Products/Services Using a Variety of Contract Types - 10%
  • Negotiates contracts and agreements when precedents are well established, and the bargaining positions are close
  • Assists in planning the negotiation strategy, coordinates the strategy with the negotiation team, and leads the negotiations which are conducted with contractors/grantees to develop the contact/grant prices and terms.

Policy Research, Analysis, and Interpretation - 10%
  • Researches and analyzes a factual procurement policy or procedural question and provides advice on appropriate procurement methods and procedures.
  • Responds to protests by researching and developing necessary analysis, documentation, and history.
  • Works with the GC in preparing the Agency's position and Contracting Officer reports to support the Government's defense on protests to the GAO.
  • Other duties as assigned

Qualifications
  • High School Diploma or GED equivalent
  • Background check required

Knowledge, Skills and Abilities
  • Knowledgeable of contracting principles, laws, statutes, Executive Orders, regulations and procedures applicable to pre-award and/or post-award actions sufficient to procure and/or administer contracts for a variety of specialized equipment, services, and/or construction, or to conduct studies of problem areas and develop standard methods and operating procedures.
