Responsibilities

The Office of Enforcement Analysis (OEA) collects and analyzes all-source information to inform and make recommendations on export transactions. OEA conducts screening and evaluation of transaction parties to export license applications and shipper's export declarations using analytical techniques designed to identify actual or potential violations of the Export Control Reform Act (ECRA) and the Export Administration Regulations (EAR). OEA targets end-use checks (EUCs) through its end-use verification program, and Export Control Officers stationed overseas build capacity of foreign governments and train foreign industry on export control implementation. OEA also develops enforcement leads, including for prevention purposes, and provides case support to Office of Export Enforcement Field Offices across the United States.

As the Director, Office of Enforcement Analysis, responsibilities include:

-Provides oversight of office personnel, resources, and activities for four separate divisions, as well as contract staff and detailees from other Federal agencies.

-Ensures that all OEA activities are accomplished in a satisfactory manner. This includes establishing priorities and schedules for all divisions and coordinating activities with the Director of the OEE as well as the Assistant Secretary for Export Enforcement.

-Formulates programs aimed at the prevention and identification of export violations, including (1) programs to enhance the collection and analysis of information from all-source information resources to develop diversion risk assessment criteria for the review and evaluation of export license applications; and (2) programs designed to disseminate information on suspected or proven export control violations.

-Manages the Information Triage Unit, involving the review of transaction parties to license applications and identification of derogatory information to inform licensing officers across the interagency.

-Manages BIS's End-Use Verification Program and serves as the technical expert in discussions regarding BIS's End-Use verification program.

-Acts as BIS's Unverified List (UVL) coordinator and lead representative. UVL is a listing of parties, published in the Federal Register, for which BIS has not been able to verify bona fides as foreign end-users of sensitive U.S.-origin technologies.

-Administers Export Enforcement's Lead Generation Program and is responsible for developing new techniques to enhance the number and quality of investigative leads referred to the Office of Export Enforcement criminal investigators for further investigative activity.

-Manages License Application Coding and Screen Reviews. Establishes screens and makes recommendations for license applications based on enforcement equities.

-Provides technical advice and assistance to the Assistant Secretary for Export Enforcement, the Under Secretary for Industry and Security, and the Deputy Under Secretary for Industry and Security on proposals and policies that relate to, and impact the implementation of the Department's export enforcement programs.

-Serves as a senior advisor and technical expert on the collection, evaluation, and effective use of export enforcement intelligence in joint activities with Export Administration licensing offices.

-Prepares and/or coordinates the preparation of Congressional, Presidential, and other controlled correspondence on export enforcement operations and policies.

-Makes public presentations to industry representatives, other U.S. Government agency officials, and foreign government export control officials concerning Export Enforcement programs. The incumbent also serves as a technical representative for BIS on interagency committees representing the U.S. Government at forums abroad.

The selectee is subject to Department approval. Initial appointment to the SES must have ECQs certified by an Office of Personnel Management Qualifications Board prior to appointment.

Qualifications

To qualify, applicants must provide evidence of progressively responsible executive level leadership experience and office management experience directly related to the skills and abilities outlined under the Executive Core Qualifications (ECQs) and their fundamental competencies and Professional/Technical Qualifications (PTQs). The ECQs were developed to assess executive experience and potential, not to evaluate technical experience. ECQs measure whether an individual has the broad experience needed to succeed in a variety of SES positions. An individual's total experience must demonstrate the ability to perform the duties of the position. Applicants must meet all of the qualification requirements by the closing date of this announcement. ECQ narratives must be no more than ten pages total, PTQs must be no more than six pages total.

EXECUTIVE CORE QUALIFICATIONS (ECQs):

PROFESSIONAL TECHNICAL QUALIFICATIONS (PTQs):

1. Demonstrated ability to solve systemic problems; grasp conceptual ideas and exercise original analytical thought; present well-considered and sound recommendations and investigative analysis; formulate and propose to higher authorities priorities, analyses, objectives, and program activities and operations; employ innovative and creative approaches to the establishment of systematic processes for the collection, analysis and dissemination of data and intelligence; and ensure that such activities are consistent with export control national policy guidelines and programs.

2. Knowledge of ECRA and the EAR, related export control laws, requirements, regulations, procedures, forms, and precedent court or legal decisions; general knowledge of current history and international affairs; and the ability to apply inductive and deductive reasoning and knowledge to the specialized subject matter of export controls.

-Background Investigation Required: A Top Secret/SCI security clearance. Position is designated special-sensitive, requiring that a background investigation be conducted and favorably adjudicated in order to establish security eligibility.

-Financial Disclosure: This position is covered under the Ethics in Government Act, which requires comprehensive financial disclosures from employees. The appointee is required to file a Public Financial Disclosure Report within 30 days after appointment, and then annually thereafter.

-Qualifications Approval and Probationary Period: Persons newly selected for SES career appointment must have their executive core qualifications approved by the Office of Personnel Management and will be required to serve a one-year probationary period.
