Summary

This position is within the Division of Regulatory and Policy Coordination within the Indian Health Service in Rockville, Maryland. The incumbent in this position serves as the authority in the Freedom of Information Act (FOIA) for the Indian Health Service. The incumbent also collaborates with Indian Health Service Area Freedom of Information Act (FOIA) coordinators to recommend courses of final action. This position reports to the Director, Division of Regulatory and Policy Coordination.

Responsibilities

  • Review documents to determine whether they are/are not subject to withholding under the Freedom of Information Act (FOIA). To the extent authorized by delegations to Indian Health Service (IHS) determines whether to disclose or deny the release of records in response to requests for records made under the Freedom of Information Act. Prepares all documentation and releases documents that are not subject to withholding under the Freedom of Information Act.
  • Serve as an Indian Health Service (IHS) Authority in the Freedom of Information Act (FOIA), advise the Freedom of Information Act and Privacy Act Officers when appropriate on the application of the statute and regulations to individual requestors. Provides interpretation of the Freedom of Information Act (FOIA) regulations to the Indian Health Service (IHS) personnel and public, with regard to requests that involve litigation, consults with Office of General Counsel (OGC). Advises Area Freedom of Information Act Coordinators on the releasability of information.
  • Coordinate requests for information with the Area Freedom of Information Act Coordinators and recommend courses of final action. Review letters and other records generated by Area Freedom of Information Act coordinators to ensure that they conform to Indian Health Service (IHS), Public Health Service (PHS), and Departmental regulations and policies and the appropriateness of materials to be released.
  • Receive and process Freedom of Information Act appeals of Indian Health Service determinations and prepare documents for the Health and Human Services Appeals Officer review and decision. Determination and responses to appeals are based on law and policy and must be capable of withstanding possible court challenges.
  • Maintain a current computerized data base and other records of the processing of Freedom of Information Act requests and monitor the progress of requests being processed. Finalize agency Freedom of Information Act annual report to the department.

In addition to the Basic Requirements, you must also meet the Minimum Qualifications stated below.

MINIMUM QUALIFICATIONS:
Your resume must demonstrate at least one (1) year of specialized experience equivalent to at least the next lower grade level in the Federal service obtained in either the private or public sector performing the following type of work and/or tasks: Serve as a comprehensive advisor of the Freedom of Information Act (FOIA) and Privacy Act (PA). Gathering and organizing documents; analyzing varieties of facts, drawing conclusions, and implementing final decisions. Determining requests in either Freedom of Information Act, Privacy Act, or administrative channels. Conducting training and providing technical assistance related to the Freedom of Information Act.

Time In Grade
Federal employees in the competitive service are also subject to the Time-In-Grade Requirements: Merit Promotion (status) candidates must have completed one year of service at the next lower grade level. Time-In-Grade provisions do not apply under the Excepted Service Examining Plan (ESEP).

Federal Employees earn annual leave at a rate (4, 6 or 8 hours per pay period) which is based on the number of years they have served as a Federal employee. IHS may offer newly-appointed Federal employees credit for their directly related previous non-federal experience or active duty uniformed military service. This credited service can be used in determining the rate at which they earn annual leave.

This position is covered by a Bargaining Unit.
