Responsibilities

This position is located in the Office of the General Counsel, Office of the Solicitor.

The duties and responsibilities of the position include:
  • Serving as counsel to the Director of the Office of Enrollment and Discipline ("OED Director") in disciplinary cases before administrative law judges and in cases on appeal to the USPTO Director.
  • Handling all aspects of disciplinary cases from inception through trial and appeals. Responsibilities include collaborating with the OED Director to complete investigations; developing litigation strategy; drafting complaints; drafting and responding to discovery motions, dispositive motions, and other pretrial motions; taking and defending depositions; conducting trials; and drafting and responding to post-trial briefs and appeals.
  • Assisting in representing the USPTO in appeals of disciplinary cases, and potentially patent and trademark cases, filed in federal district and appellate courts.
  • Providing legal advice on ethics and disciplinary matters to the OED Director, OED staff attorneys, and Agency officials.

During the current period of maximum telework required by the Agency's COVID-19 response, full-time telework is available, including for the onboarding process. When it is determined the Agency will be moving to the reopening phase, this position will be physically stationed in Alexandria, VA, and will remain telework-eligible consistent with USPTO OGC policies. Those policies currently permit telework up to two days per week, but the office is reevaluating its existing policies and may further expand telework in the near future.

Qualifications

The Office of Personnel Management (OPM) has not issued qualification standards for Attorney positions. However, the agency sets minimum qualifications for Attorney positions and sets forth these qualifications for each vacancy announcement. You must meet all eligibility and qualification requirements by the closing date of the job announcement.

Professional Specialized Experience is post J.D. legal experience that demonstrates that the applicant possess the particular knowledge, skills, and abilities to perform successfully the duties of the position to be filled.

Applicants must have at least four (4) years of post J.D. professional specialized experience in litigation matters. Litigation experience in the area of attorney ethics and disciplinary enforcement is preferred but not required. The experience should include: (1) drafting complaints; (2) drafting and responding to pretrial motions; (3) taking and defending depositions; and/or (4) conducting trials before a judge or jury.

Demonstrated proficiency in applying the USPTO Rules of Professional Conduct and a working knowledge of the American Bar Association (ABA) Model Rules of Professional Conduct is preferred but not required.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Education

Applicants must possess a Juris Doctor (J.D.) degree or Master of Laws (L.L.M.) degree from an ABA accredited law school.

In addition: You must be an active member of the Bar in Good Standing of any state, District of Columbia, Puerto Rico, or any U.S. territory.
