The National Science Foundation is seeking qualified candidates for an Attorney Advisor DETAIL position in the Office of the General Counsel (OGC) within the Office of the Director (OD), Alexandria, VA.

Responsibilities

The OGC is the legal advisor and advocate for the Foundation, providing legal advice and assistance on all aspects of the Foundation's programs, policies, and operations, as well as areas affecting science and technology more broadly. Advice is provided in a wide variety of areas, such as: grants, contracts and cooperative agreements; intellectual property; conflicts-of-interest; employee and labor relations; civil rights; health, safety and environment; Federal fiscal and administrative law and procedure; and international law and agreements. OGC coordinates with U.S. Department of Justice regarding litigation matters involving the foundation.

The individual selected for this position will be detailed to NSF Office of the General Counsel to assist in intellectual property and licensing, including:
  • Advising on the Bayh-Dole Act and regulations
  • Reviewing operations of the I-Edison system and advising on transfers/waivers and other functions
  • Facilitating intellectual property related aspects of NSF partnerships and consortia
  • Advising on licensing terms and agreements as well as facilities or user agreements
  • Advising on other arrangements and other transactions authorities and applications
  • Advising on copyrights and trademark issues in particular as they relate to NSF partnerships
  • Coordinating with the government information attorney and other subject matter expert attorneys on concluding NSF partnership and other agreements and understandings.

Failure to comply with this NSF policy could result in disciplinary action up to and including removal from Federal Service or termination of an IPA assignment and referral to the Office of Inspector General.

Qualifications

Candidates must have a J.D. from a school of law accredited by the American Bar Association (ABA), plus after award of the J.D., six or more years of professional legal experience. Candidates must have significant expertise related to the Bayh-Dole Act and regulations and experience with public-private partnerships.

Bar Membership: Candidate must be a member in good standing of the bar of a State, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

This position is outside the competitive civil service.

This position may be filled by an individual internal or external to NSF. If external to NSF, a Memorandum of Understanding will be established between agencies prior to temporary entrance on duty. Coordination between agencies will be required to determine the appropriate salary level authorized for the selected candidate. If the selected candidate is not a current Federal employee, this will be processed as a temporary appointment NTE one year.
