Summary

This position is located in the Office of the General (OGC), Pension Benefit Guaranty Corporation (PBGC). OGC provides legal advice and counsel for the Director and the Corporation, including ERISA and/or bankruptcy related legal actions; decides administrative appeals of benefit coverage and other determinations, and administers the disclosure and other requirements of the Freedom of Information ACT (FOIA) and the
Privacy Act. The incumbent will serve as the Deputy Chief Privacy Officer.

Responsibilities

  • Serve as Agency Chief Privacy Officer (CPO) when the CPO is unavailable,
  • Analyze the most complex privacy issues, identify applicable legal sources, and determine need for additional facts or investigation.
  • Coordinate the annual security and privacy accreditation reviews for assigned FISMA systems, which include reviewing privacy and security controls and recommending new or revised security and privacy measures.
  • Design, develop, and implement a modernized Breach Response Program and administer the day-to-day operation of Breach Tracking and response, in accordance with appropriate policies and procedures.
  • Develop and conduct privacy training, including role-based training.
  • Collaborate with business units to ensure successful integration of privacy considerations in the appropriate business operations and IT systems.
  • Advise PBGC managers and employees, including senior management, regarding all aspects of U.S. privacy laws and regulations, such as the Privacy Act of 1974, the E-Government Act of 2002, OMB Circulars and Memoranda, and NIST guidance.
  • Serve as principal representative on key committees and task forces.
  • Participate in and contribute to the development of legal policy.

Qualifications

To qualify for this position, you must have at least one year of experience at the GS-14 grade level (in the Federal service) or equivalent to the GS-14 grade level (in the private sector) in:
• analyzing complex privacy law issues and communicating effectively, including making presentations to management;
• Addressing privacy breaches;
• Working with attorneys and IT professionals on privacy and cybersecurity issues;

PLEASE NOTE: If you are currently serving or have previously served in the series in the Federal government for which this position is being advertised, you do not need to submit a transcript(s) if you submit an SF-50 that provides proof of you having been in the series.

Education

In order to qualify for this position, you must possess a J.D. degree from a school of law accredited by the American Bar Association (ABA).
In addition to the education requirement, you must currently be a member in good standing of the bar of a State, a Territory of the United State, or the District of Columbia.

Education must be accredited by an accrediting institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications. Therefore, provide only the attendance and/or degrees from schools accredited by accrediting institutions recognized by the U.S. Department of Education.

IAPP (International Association of Privacy Professionals) certification preferred but not required.

WRITING SAMPLE: Each applicant must submit an original sample of their unedited written work that does not exceed ten pages in length (double or single spaced). The writing sample should demonstrate legal analysis.
