Summary

The Director, Office of Privacy and Open Government serves as the Chief Privacy Officer and Director of Open Government and is responsible for overseeing the entire comprehensive privacy and open government portfolio for the Department of Commerce a large and significant task. In addition, this position oversees the Department's open government program, including FOIA portfolio.

Responsibilities

The Chief Privacy Officer and Director of Open Government maintains responsibility for the overall development and maintenance of privacy policies, procedures, and guidance essential to the effective and efficient implementation of these activities. Responsibilities include:

-Serves as the key advisor on issues related to compliance with the Privacy Act of 1974 and Federal Information Security Management Act provisions on privacy, as well as the E­ Government Act of 2002, Freedom of Information Act (FOIA) requests, Transparency and Open Government activities, Federal Advisory Committee Act (FACA) matters and management of the Departments' directives system and relevant Executive Orders.

-Serves as the senior Department of Commerce authority on matters relating to public disclosure of information, advising on privacy issues related to informed consent, disclosure risk, record linkage, and data sharing.

-Develops and implements DOC's Open Government efforts through leading and participating in interagency initiatives, in-person and online public engagements and internal programs that include training, collaboration, and modification of existing internal processes.

-Ensures that Departmental programs are in compliance with the President's principles of transparent and open government, aligning programs and initiatives to the mission and fostering continued program improvements.

-Advises internal groups and committees tasked with making program and major policy and IT decisions and serves as a core voting member and executive director of the Department's Privacy Policy Council and chair of its Breach Notification and Response Task Force.

-Assures that personal information contained in Privacy Act systems of records is handled in full compliance with fair information practices as defined in the Privacy Act of 1974.

-Ensures program privacy policies and principles are reflected in all operations.

-Ensures bureaus' compliance with Departmental and data protection policies, and continually strives for privacy best practices.

-Manages and oversees the Department's FOIA activities and implements the Department's FOIA policy concerning the development of programs required by the FOIA for public access to Departmental information.

-Develops and implements the process for receiving, reviewing, commenting, and approving Privacy Impact Assessments in connection with E-Government Act requirements and the Homeland Security Act.

-Ensures privacy impact assessments are conducted according to proposed rules of the Department on the privacy of in formation in an identifiable form, including the type of personally identifiable information collected and the number of people affected.

-Manages and oversees the Department's directives system and Federal Advisory Committee Act (FACA) activities.

If you are currently serving under a career Senior Executive Service (SES) appointment, are eligible for reinstatement into SES, or have successfully completed a SES Candidate Development Program (CDP) approved by the Office of Personnel Management (OPM) and had your ECQs certified by OPM, then you only need to address each PTQ, and you do not need to submit an ECQ narrative. All other applicants are required to respond to all ECQs and PTQs, addressing each ECQ and PTQ separately. You MUST attach supporting documentation with your application.

The selectee is subject to Department approval. Initial appointment to the SES must have ECQs certified by an Office of Personnel Management Qualifications Board prior to appointment.

OPM must authorize any employment offers made to current or former (within the last 5 years) political Schedule A, Schedule C, or Non-career SES employees in the executive branch. Qualifications

To qualify, applicants must provide evidence of progressively responsible executive level leadership experience and office management experience directly related to the skills and abilities outlined under the Executive Core Qualifications (ECQs) and their fundamental competencies and Professional/Technical Qualifications (PTQs). The ECQs were developed to assess executive experience and potential, not to evaluate technical experience. ECQs measure whether an individual has the broad experience needed to succeed in a variety of SES positions.

EXECUTIVE CORE QUALIFICATIONS (ECQs):

ECQ 1 - LEADING CHANGE: This core qualification involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment. (Competencies: creativity and innovation, external awareness, flexibility, resilience, strategic thinking, vision)

ECQ 2 - LEADING PEOPLE: This core qualification involves the ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts. (Competencies: conflict management, leveraging diversity, developing others, team building)

ECQ 3 - RESULTS DRIVEN: This core qualification involves the ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks. (Competencies: accountability, customer service, decisiveness, entrepreneurship, problem solving, technical credibility)

ECQ 4 - BUSINESS ACUMEN: This core qualification involves the ability to manage human, financial, and information resources strategically. (Competencies: financial management, human capital management, technology management)

ECQ 5 - BUILDING COALITIONS: This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. (Competencies: partnering, political savvy, influencing/negotiating)

PROFESSIONAL TECHNICAL QUALIFICATIONS (PTQs):

1-Demonstrated knowledge of Federal laws, policies, regulations, and precedents applicable to privacy and confidentiality sufficient to serve as the Departmental expert, which includes providing advice to senior-level management and other offices on the Privacy Act and other privacy related matters.

2-Demonstrated knowledge of data collection; data dissemination; and information technology sufficient to plan and manage the implementation of Privacy Act standards and safeguards for ensuring protection of information through Department's IT systems.

3-Demonstrated skill conveying complex and detailed information to guide the Department in handling unique privacy and information management issues and skill in managing the implementation of policies and procedures among a diverse range of stakeholders.

Desirable Technical Qualification:

Experience applying an Information Privacy Professional/Government certification from the International Association of Privacy Professionals (JAPP) or equivalent professional training as a privacy professional. Indicate if you do have a formal Information Privacy Professional/Government certification from the IAPP.

Background Investigation: This position is designated as non-sensitive and requires that a background investigation be conducted and favorably adjudicated.

Financial Disclosure: This position is covered under the Ethics in Government Act, which requires comprehensive financial disclosures from employees. The appointee will be required to file a Public Financial Disclosure Report (SF-278), within 30 days after his/her appointment, and then annually thereafter.

Qualifications Approval and Probationary Period: Persons newly selected for career appointment to the Senior Executive Service must have their executive core qualifications approved by an Office of Personnel Management Qualifications Review Board and will be required to serve a one-year probationary period.

Mobility: Individuals selected for Senior Executive Service positions may be subject to reassignment across geographical, organizational, and functional lines.

Drug Testing: Applicants tentatively selected for employment in any position are subject to designated and/or random urinalysis to screen for illegal drug use prior to appointment. Applicants who refuse to be tested will be denied employment with the Department of Commerce.

The physical worksite is located in Washington, DC. However, the Office of the Secretary is currently under a maximum telework posture due to the COVID-19 pandemic; therefore, this position is currently under a 100 percent telework schedule. The position's telework schedule will likely change in the future when it moves away from its maximum telework posture. At that time, the incumbent will be expected to report to the physical work site in accordance with the updated status requirements of their supervisor. The nature and scope of future telework opportunities will be subject to the unit's telework policy, any applicable bargaining unit agreements, and supervisory approval. Non-compliance with the supervisor's telework-schedule requirement could result in adverse action, including separation.
