Summary

As a General Attorney (Civil Rights), you will be part of the Appellate Litigation Services section in the Office of General Counsel. You will be responsible for litigating challenging and significant employment discrimination cases in the federal courts of appeals.

Responsibilities

  • Prepares briefs and presents oral arguments in federal courts of appeals. Prepares other appellate filings, including motions and petitions for rehearing.
  • Participates in all necessary appellate mediation conferences, and drafts any required settlement agreements and memoranda.
  • Prepares memoranda and draft briefs for the Office of the Solicitor General at the Department of Justice in Supreme Court cases.
  • Drafts memoranda addressing whether the Commission should seek further review of adverse decisions or participate as amicus curiae in employment discrimination appeals.
  • Handles appellate cases arising under all of the statutes(**) that EEOC enforces against private-sector employers. (**see statutes below)
  • Works closely with the Office of the Solicitor General at the Department of Justice to represent the EEOC's interests in employment discrimination cases before the United States Supreme Court.
  • Conducts legal research and analysis of factual and legal issues presented; develops legal arguments and strategies.
  • Represents the Commission in appellate cases handled by the Department of Justice that affect the Commission, including defensive litigation.
  • Provide formal and informal legal advice and memoranda to agency leadership.
  • **Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act of 1990, the Age Discrimination in Employment Act of 1967, the Equal Pay Act of 1963, and the Genetic Information Nondiscrimination Act of 2008.

Qualifications

For the GS-13:You must have earned a professional law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association, be an active member of the Bar, and have two years of professional legal experience with at least one year being equivalent to the GS-12 level. Professional legal experience includes experience as a judicial clerk.

For the GS-14:You must have earned a professional law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association, be an active member of the Bar, and have three years of professional legal experience with at least one year being equivalent to the GS-13 level. Professional legal experience includes experience as a judicial clerk.

Professional legal education above the first professional law degree may be substituted for experience required as follows:(a) The second professional law degree (LL.M.) may be substituted for one year of experience; and b) the third law degree (J.S.D.) may be substituted for one year of experience beyond the LL.M.

The following is preferred but not required:
Appellate litigation experience and/or substantive expertise in the employment discrimination laws enforced by the EEOC; judicial clerkships; law journal; moot court; clinical experience; and skills and experience working cooperatively and productively with a range of people.
