Responsibilities

* This vacancy has been extended until April 23, 2021.

This position is located in the Office of Enrollment and Discipline in the Office of General Counsel.

Incumbent is responsible for the following:
  • Completing investigations, preparations, arguments and general conduct of the full range of highly controversial disciplinary cases involving ethical and legal considerations, which require extensive research and analysis and investigating the good moral character and reputation of candidates seeking recognition to practice before the United States Patent and Trademark Office.
  • Coordinating and assisting with preparing a nationwide examination of the candidate's proficiency in patent law and USPTO office regulations, policies, and procedures to be registered as a patent attorney or agent.
  • Eliciting and evaluating evidence and testimony; preparing letters, interrogatories, formal complaints (37 CFR 11.34) and other documentation, including drafting decisions affecting the enrollment of attorneys and agents.
  • Interviewing complainants, practitioners and others having knowledge material to an investigation or disciplinary proceeding.
  • Preparing disciplinary matters for presentation to the Committee on Discipline for a probable cause determination; and adjudicating petitions for reinstatement from practitioners who have been suspended or excluded from practice before the United States Patent and Trademark Office.
  • Adjudicating registration applications and petitions having highly complex factual or legal issues which involve the interpretation and application of legislation and regulations and which require a high order of original and creative legal endeavor in order to obtain a reasonable balance of conflicting public and private interests.
  • Conducting outreach efforts to educate the public and patent and trademark practitioners on applicable professional standards and best practices.
  • Assisting with developing policies and procedures for the preparation and submission of the online registration statement, which is to be submitted by practitioners who practice before the USPTO in patent matters.

The physical worksite for this position is located in Alexandria, VA. However, the United States Patent and Trademark Office is currently under a mandatory telework posture due to the COVID-19 pandemic; therefore, this position is currently under a 100 percent telework schedule. The position's telework schedule will likely change in the future when USPTO moves away from its mandatory telework posture. At that time, the incumbent will be expected to report to the physical work site in accordance with the updated status requirements of their supervisor. The nature and scope of future telework opportunities will be subject to the unit's telework policy, any applicable bargaining unit agreements, and supervisory approval. Payment of relocation expenses, as applicable, will be paid in accordance with this Job Opportunity Announcement. Non-compliance with the supervisor's telework-schedule requirement could result in adverse action, including separation.

Qualifications

You must meet the United States Office of Personnel Management's (OPM) qualification requirements (including specialized experience and/or educational requirements) for the advertised position. Specialized Experience: is experience that has equipped applicants with the particular knowledge, skills and abilities to successfully perform the duties of the position, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level in the federal service.

GS-14 - The next lower grade level is a GS-13.

Must have 3 years of professional legal/law experience (listed below) defined as post J.D. professional experience performing attorney duties; AND 1 year of the following Specialized Experience:

Experience includes investigating or litigating allegations of (i) ethical misconduct by attorneys or other licensed professionals; (ii) fraud, waste, abuse, or prohibited personnel practices by government employees or officials; or (iii) criminal activity.

GS-15 - The next lower grade level is a GS-14.

Must have 4 years of professional legal/law experience (listed below) defined as post J.D. professional experience performing attorney duties; AND 1 year of the following Specialized Experience:

Experience includes investigating or litigating allegations of (i) ethical misconduct by attorneys or other licensed professionals; (ii) fraud, waste, abuse, or prohibited personnel practices by government employees or officials; or (iii) criminal activity.

Professional legal experience, post J.D. is defined as:
  • Professional legal/law experience that has equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position to be filled.
  • Legal work is described as extremely complex and difficult and requires a high order of original and creative legal endeavor in balancing conflicting interests; has broad or wide-scope impact on an economy, industry, private or public interests; and may involve directly or indirectly very large sums of money.
  • Work may also involve acting as principal attorney in charge of the preparation and presentation of cases; recommending policies and developing procedures and regulations to implement new or amended legislation; and acting as legal, general or senior counsel to a major firm or organization.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Education

Applicants must possess a Juris Doctor (J.D.) degree or Master of Laws (LL.M.) degree from an American Bar Association accredited law school.
