As a Supervisory Patent Attorney, you will be working within the largest IP Rights governing body in the nation. You will be supporting economic growth and positioning America as the hub of critical thinking on patent-related matters in the world. The Leahy-Smith America Invents Act (AIA) (Public Law 112-29; Sept. 16, 2011) has made the Patent Trial and Appeal Board (PTAB) the cutting edge of evolution in patent law.

The individual selected for this position will:
  • Analyze procedures before the Board and develop desirable Rule changes pertinent thereto.
  • Make authoritative interpretations of legal precedents which involves decisions on the technology reviewed by patent attorneys under his/her supervision, and perform a number of related duties such as determining whether two or more applications contain interfering subject matter.
  • Review and analyze current and proposed patent laws, regulations, guides and directives and provide substantive technical guidance on subject issues.
  • Develop policies, regulations and other guidance related to review of adverse decisions of examiners upon applications for patents, or in reexaminations proceedings, determination of priority and patentability of invention in interference declared, as well as AIA trial proceedings and other possible future statutory duties.
  • Exercise the full range of supervisory duties including, reviewing and evaluating the performance for all patent attorneys under his/her supervision for compliance with standards and assigning work.
  • Prepare reports and maintain records of work accomplishments and administrative information and coordinates the preparations, presentation, and communication of work-related information to management.

To qualify for this position, you must meet the following Qualifications:

To be considered for this position, you must possess the following:

(A) Proof of successful completion of a full 4-year course of study in an accredited college or university leading to a bachelor's or higher degree in the study of engineering, chemistry, or biology. For an engineering degree, the curriculum must:

1. Be accredited by the Accreditation Board for Engineering and Technology (ABET) as a professional engineering curriculum;

OR

2. Include differential and integral calculus and courses (more advanced than first-year physics and chemistry) in five of the following seven areas: a) statics, dynamics b) strength of materials (stress-strain relationships) c) fluid mechanics, hydraulics d) thermodynamics e) electrical fields and circuits f) nature and properties of materials (relating to particle and aggregate structure to properties) g) any other comparable area of fundamental engineering science or physics, such as optics, heat transfer, soil mechanics or electronics

OR

(B) A combination of Education and Experience. This combination of college level education, training and/or technical experience must have furnished both:

• A thorough knowledge of the physical and mathematical sciences underlying professional engineering;

AND

• A good understanding, both theoretical and practical, of the engineering sciences and techniques and their application to professional engineering. This can be demonstrated by one of the following:

1. Professional registration-- Current registration as a professional engineer by any State, the District of Columbia, Guam or Puerto Rico.

2. Written test-- Evidence of passing the Engineer-in-Training (EIT) examination or the written test required for professional registration, administered by the Boards of Engineering Examiners in various States, the District of Columbia, Guam and Puerto Rico.

3. Specified academic courses-- Successful completion of at least 60 semester hours in the physical, mathematical and engineering sciences and including the courses specified in the basic requirements. The courses must be fully acceptable toward meeting the requirements of a professional engineering curriculum as described in paragraph A. 4. Related curriculum-- Successful completion of a curriculum leading to a bachelor's degree in engineering technology or in an appropriate professional field, e.g., physics, chemistry, biology, architecture, computer science, mathematics, hydrology, or geology, may be accepted in lieu of an Engineering degree, provided the applicant has had at least 1 year of professional engineering experience with professional engineering supervision and guidance.

AND

(C) Proof of successful completion of a law degree (minimum: J.D. or equivalent). (D) Proof of active membership of the Bar of any state, District of Columbia, Puerto Rico, or any U.S. territory, in good standing. In addition to the education requirement, applicants must also meet the specialized experience.

Specialized Experience is experience that has equipped you with the particular knowledge, skills and abilities to perform successfully the duties of the position, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level in the federal service.

Candidates for the GS-15 grade level must have at least 52 weeks of specialized experience equivalent to the GS-14 grade level in the Federal service. Specialized experience for this position is exerience with the following skill sets:

Experience analyzing and interpreting of patent laws and regulations, and applicable technologies to generate and develop new hypotheses and theories relative to patent prosecution or examination of patent applications.

Experience leading a team using team building skills and techniques to ensure efficient and adequate outcomes and results.

Experience identifying long-range implications of proposed actions and preparing a plan to address such impacts.

Education

This position does have a positive education requirement. In addition to the qualifications requirements all candidates must possess a J.D. or LL.B degree from an accredited law school, AND must be a member in good standing of the appropriate licensing authority of any state in the U.S. or the District of Columbia Bar.
