Summary

This position is located at USDA, Agricultural Research Service, Research Operations and Management, Technology Transfer with one vacancy in Beltsville, MD.

This position manages the operations of the USDA ARS Patent Program, overseeing the preparation and prosecution of all patent applications including Patent and Plant Variety Protection (PVP) applications and the counseling of inventors/employees including identification of cases available for foreign filing.

Responsibilities

  • Balances patent application workload, and serves as the senior technical expert to the Assistant Administrator, OTT, and Deputy Assistant Administrator, OTT, on issues of patent and PVP practice and ARS policies and procedures related thereto.
  • Provides expert technical advice and recommendations on USDA and ARS policies and procedures for patent and plant variety protection of USDA inventions.
  • Manages and serves on all ARS utility patent, Ad Hoc and plant protection committees providing input on discussions, committee criteria, voting, and final decisions made by the Office of Technology Transfer.
  • Oversees the identification of patentable subject matter arising from USDA research through the evaluation of non-CRADA 115s (Request to Submit Manuscript for Publication).
  • Prepares and prosecutes provisional, United States (US), and PVP applications as required by patent laws and regulations within statutory time limits for filing in US and other country patent offices from information supplied by the inventors.
  • Ensures in-depth investigations are completed to determine salient facts, uses findings to resolve issues, or furnishes facts and recommendations to other authorities for resolution.

Qualifications

GS-15 Basic Requirements:

A. Degree: Successful completion of a full 4-year course of study in an accredited college or university leading to a bachelor's or higher degree or with a major in a scientific, technological, or engineering field pertinent to the position to be filled, as shown in paragraph A of the individual occupational requirements for the particular series, e.g., Biological Sciences, Chemistry, Engineering, etc.

OR

B.Combination of education and experience -
that meets the paragraph B provision of the individual occupational requirements for the particular series pertinent to the position to be filled, e.g., Biological Sciences, Chemistry, Engineering, etc.

OR

C. Four years of scientific,
technological, or engineering experience that demonstrated knowledge of the fundamental principles of the field involved in the position to be filled equivalent to that which would have been obtained through successful completion of a full 4-year degree as shown in A above.

Evaluation of Experience: Professional patent work experience that involved either the examination or the preparation and prosecution of applications for U.S. Patents; or experience gained as a Patent Attorney, Patent Adviser, Patent Examiner, Patent Classifier, Patent Interference Examiner, Patent Research and Development Examiner, Patent Examiner Specialist, or Law Examiner (Patents) is accept-able for any of the professional experience as required above.

Specialized Experience: Specialized experience is experience directly related to the position to be filled. The specialized experience requirements for this position are:

GS-15: Qualifying experience for GS-15 includes one year of specialized experience comparable to GS-14 which is directly related to the work of this position and which has equipped the applicant with the knowledge, skills, and abilities to perform successfully the duties of the position. For this position, specialized experience is experience monitoring the preparation and prosecution of patent applications; providing expert advice and guidance on patent policies and procedures for an organization; conducting investigations on complex patent issues; and conducting matters of patent prosecution on behalf of inventors.

Selective Placement Factor(s): In addition to the specialized experience requirement above, this position has a selective placement factor (SPF). Selective Placement Factors are special requirements, in addition to the minimum qualification requirements, that are essential in successfully performing the duties of this job. If SPF is not in your resume or a certificate is not provided, you will not receive further consideration under this announcement.
- Registered to practice before the U.S. Patent and Trademark Office (USPTO) and thereby has been granted the Power of Attorney to conduct all matters of patent prosecution before the USPTO.
