(BMA) Integrating People and Process Through Service, with a strategic emphasis on integrating people and process, and proven, documented project management methodology for internal and external management while maintaining a strategic and financial focus on an organizations most important component it's people;"Love Thy Customer; Love Thy Work; Love Thy System"Business Management Associates (BMA) is seeking EEO Counselors who perform counseling of informal complaints of discrimination in accordance with 29 CFR Part 1614, EEOC Management Directive 110 (EEOC MD-110), and the guidance contained in agency's EEO Counselor's Guide (hereinafter "Counselor Guide").RESPONSIBILITIES & DUTIES: Initiate telephonic contact with the aggrieved within three (3) calendar days of receiving the assignment to establish a date/time for the initial interview. Conduct an initial interview with the aggrieved (telephonic or in-person). When conducting the initial interview, the following action items must occur:o issue the Aggrieved Notice of Rights and Responsibilities in accordance with the Counselor Guide.o Identify all of the bases and claims/issues in the complaint and properly frame the claim(s) in accordance with EEOC Guidelines (samples provided in the Counselor Guide);o Prepare a Complaint Intake Sheet, in accordance with the Counselor Guide, allow for discussion and review, and obtain the aggrieved' s signature on the Complaint Intake Sheet indicating his/her agreement with the claims/issues to be counseled. Request and review pertinent documentation relating to the complaint and indicate what the documents revealed in the counselor's report. Additionally, the following must be accomplished:o Thoroughly interview management witnesses and obtain statements regarding the claim(s) presented.o Issue the Management Notice of Participation, Rights and Responsibilities in accordance with the Counselor Guide. Identify and interview (telephonically or in-person) other witnesses, as appropriate. The counselor should schedule interviews in advance. Seek a resolution to the complaint at the lowest possible level. Coordinate resolution efforts and settlement agreement preparation with the EEO Official Conduct a final interview with the aggrieved prior to issuance of the Notice of Right to File a Discrimination Complaint. If the aggrieved is unavailable, seek guidance from the EEO Official. Issue a Notice of Right to File a Discrimination Complaint, if the matter is not resolved, using the sample provided in the Counselor Guide. Perform FAD writing services of formal complaints of discrimination in accordance with 29 CFR Part 1614, EEOC Management Directive 110 (EEOC MD-110). Review and analyze the Report of Investigation (ROI) and issue a Draft FAD: Shall review and analyze complaint files and draft recommended FADs on the merits of the complaints of discrimination. The draft FADs will be prepared in accordance with the format provided by agency and will include, at a minimum, the following elements:o Introduction, Procedural Background and Issues, Factual background and Summary of the case, Legal Standards, Analysis and Findings, Conclusion, Decision, and Appeal Rights. QUALIFICATIONS & REQUIREMENTS: Counselor must be proficient and must possess good oral communications skills and have an in-depth knowledge of counseling requirements and techniques, as well as techniques for resolving complaints. Must demonstrate the ability to work with the aggrieved to ascertain the basis(es) and claim(s) in a complaint, remain unbiased in performing counseling duties, identify individuals having knowledge of the matters raised in the complaint, produce well-written, timely counselor's reports with an acceptable level of detail, and work within timeframes established for the counseling process. The counselor assigned to agency cases have completed the training required by EEOC MD-110 (a minimum of 32 hours initial training plus at least 8 hours of annual training thereafter). Must be an experienced in FAD writing under 29 CFR Part 1614 Experience writing FADs for consolidated complaints, complaints with multiple related and unrelated claims of discrimination, and complaints with continuing violation claims, including claims of harassment.EDUCATION & EXPERIENCE: Bachelor's Degree required Must have a completed EEOC MD-110 training (32 hours) plus 8 hours of annual training thereafter.
