Privacy Senior Counsel

About the Role:

The Capital One Legal Department is seeking an all-star attorney with a passion for privacy law. The attorney in this position will join our enterprise privacy legal team and will help support our Privacy and Data Ethics business office, which sets the privacy framework for the company, creates privacy products for our customers, and ensures we infuse privacy into everything we build and do. Working closely with business, compliance, and risk partners across each of Capital One's lines of business, you will be a go-to resource across the company on legal issues related to privacy and data protection and will be an integral part of the legal team helping the company implement new regulations, including the California Privacy Rights Act (CPRA). You will operate at the intersection of financial services and technology, and you will brainstorm, problem-solve, and innovate to assess and mitigate legal risk in a challenging and evolving space.

We are looking for an attorney who is collaborative, inquisitive, and enthusiastic about privacy and technology. You'll need strong analytical and organizational skills, great judgment, and the ability to work effectively in a fast-paced environment with complex legal issues that may arise suddenly and require quick resolution. We want someone with an ownership mentality who nonetheless enjoys being part of a team and who can interact with and influence across departments and job levels. A good sense of humor is a plus!

Responsibilities likely to include:
  • Provide expert advice on existing privacy laws, including GLBA, HIPAA, GDPR, and CCPA/CPRA.
  • Analyze and interpret new laws and regulations and assist in devising compliance methods that meet business goals and objectives.
  • Assist with contracts that touch on data privacy and protection issues.
  • Advise regarding the impact of proposed privacy law and regulation on business initiatives and employee privacy issues.
  • Manage outside counsel regarding privacy legal matters.



Basic Qualifications:
  • Juris Doctor from an accredited law school
  • Active member in good standing of at least one state bar
  • At least 5 years of experience in a law firm environment, at a government agency, or as in-house counsel


Preferred Qualifications:
  • A background in privacy law is a plus but is not required
  • Experience with application of law to new technologies or innovative uses of technology
