This position is located in the Office of the General Counsel, Executive Office for Immigration Review, U. S. Department of Justice. Incumbent serves as a Supervisory Attorney Advisor - Employee/Labor Relations (ELR).

Responsibilities

The Supervisory Attorney Advisor (ELR) manages the day-to-day operations of the ELR Unit.

Duties include but are not limited to the following:
  • Directing the work of attorneys engaged in complex and sensitive cases before Administrative Judges of the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board, (MSPB), Federal Labor Relations Authority (FLRA), and the Federal Service Impasses Panel (FSIP) that could establish agency and DOJ-wide precedents.
  • Serving as the principal EOIR point of contact for the U.S. Attorney Offices, other DOJ offices and government agencies on legal matters affecting the ELR program and provides guidance and assistance on these issues.
  • Providing oral and written and technical legal guidance to key EOIR officials at Headquarters and to offices in the field on all aspects of federal employment law and federal labor-management relations.
  • Overseeing the development of case strategy and tactics and the presentation of agency representation from initial complaint or charge until conclusion of the administrative process.
  • Representing EOIR in determining whether adverse litigation decisions should be appealed, which may require that the incumbent persuade EOIR officials, Office of Personnel Management, or JMD to appeal the decision deemed unacceptable to the agency.
  • Providing technical and administrative supervision for the attorneys and professional staff within the ELR Unit. Plans the work to be accomplished by staff.

Qualifications

In order to qualify for the Supervisor Attorney Advisor (Employee Labor Relations) position, you must meet the following minimum qualifications:
  • Education: Applicants must possess an LL.B. or a J.D. degree. (Provide the month and year in which you obtained your degree and the name of the College or University from which it was conferred/awarded.)
AND
  • Licensure: Applicants must be an active member of the bar, duly licensed and authorized to practice law as an attorney under the laws of any state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued.)
AND
  • Experience: Applicants must have four full years (48 months) of professional legal experience that includes the following:
  • Providing technical and administrative supervision over attorneys and professional staff within an organization;
  • Assigning work to subordinates (e.g. attorneys, professional staff and legal staff) based on priorities and difficulty of the assignment;
  • Developing case strategy, tactics and the presentation of agency representation in litigation from initial complaint or charge until conclusion of the administrative process; and
  • Providing oral and/or written technical legal guidance on a broad range of federal employment law and/or federal labor-management relations matters to officials and senior management.
  • NOTE: Qualifying experience is calculated only after receipt of J.D. or LL.B.
