Responsibilities

  • Please note, during the COVID-19 Pandemic, the Agency is operating in a maximum telework posture for all telework ready employees occupying a telework eligible position.
  • Selectee will serve as Assistant Counsel for the DLA Office of Counsel serving DLA Aviation.
  • Selectee will provide advice in one or more of the following assigned areas of the law as his/her primary duty. Contract law focusing especially on simplified acquisitions.
  • Legal and policy advice will cover contract formation, including, but not limited to, contract review, authority and delegations, source selection, socioeconomic issues, sourcing, commercial item contracting, protests, FOIA, pricing and fiscal law.
  • May provide legal advice, counsel, and representation in the areas of personnel, labor, and equal opportunity law.
  • May provide advice on a wide range of administrative law matters including the Freedom of Information Act, Privacy Act, fiscal law, ethics, contract fraud, installation law, and law enforcement questions.
  • Duties may include providing legal advice and representation on contract administration matters, such as changes, performance, delivery and quality, terminations, alternative dispute resolution, and contract litigation.
  • Selectee may be required to provide legal representation before the Armed Services Board of Contract Appeals (ASBCA) and the Government Accountability Office (GAO).
  • Representation before the Equal Employment Opportunity Commission (EEOC), Merit System Protection Board (MSPB), and Federal Labor Relations Authority (FLRA) also may be required.

Qualifications

QUALIFICATIONSREQUIRED:

1) The first professional law degree (LL.B. or J.D.);

2) Proof that you are licensed and a member in good standing with the bar of the highest court of a State, U.S. commonwealth, U.S. territory, or the District of Columbia. Annual bar certification cards issued from your state of licensure are not considered acceptable. Proof is a "certificate of good standing" issued by your state of licensure dated within 6 months of the closing date of this announcement or a screenshot of your bar status taken from your state of licensure website that is dated within 6 months of the closing date of this announcement or sworn statement to that effect. If there is not a date on the screen shot, you must provide a statement signed by you on the date that the screen shot was created. The successful applicant selected for employment must provide a "certificate of good standing" issued by their respective bar showing they are in good status and in active status prior to appointment.

3) In addition to 1 and 2 (listed above), each grade level has the following qualification requirements:

To Qualify at the GS-13 Level , one of the following requirements must be satisfied:
a. Two years of professional legal experience at or equivalent to the GS-12 level.

b. The second professional law degree (LL.M.) plus 2 years of professional legal experience at or equivalent to the GS-12 level.

c. An attorney without experience may, in unusual cases, be employed at the GS-13 or equivalent level provided the individual has advanced educational attainments substantially beyond those required for work at the GS-12 or equivalent level, and his or her education clearly indicates ability to perform work of the type.

In accordance with DoDI 1442.2 (Personnel Actions Involving Civilian Attorneys). Promotion for this position is based on the individuals time, performance, and mastery of skills at the required grade level and only with approval of the designated official (DLA General Counsel) in accordance with the applicable regulation.

The PRINCIPAL SELECTION FACTORS for this position are as follows (Narrative Statement Required):
  • Ability to provide accurate, timely, responsive, and ethical legal advice and counsel that addresses the operative facts and applicable law and provides clear and workable guidance.
  • Ability to provide effective support working cooperatively with senior level civilian and military clients using problem-solving skills to facilitate consensus solutions.
  • Analytical/legal ability (including issue identification, legal research, analysis of options, risk analysis, creative problem-solving).
  • Excellent oral and written communication skills and proficiency as an advocate.
  • Excellent interpersonal skills and client relationships, and the ability to interact well with senior officials on controversial and sensitive issues.
ACTIVE DUTY SERVICE MEMBERS: The VOW Act requires federal agencies to treat an eligible active duty service member as a veteran, disabled veteran, and preference eligible (as applicable) when applying for civil service positions before the effective release or discharge date. Appointment of military members before the release or discharge date is permissible if the member is on terminal leave. At the time the active duty member applies for a civil position, he or she must submit a "certification" memo in lieu of a DD-Form 214, Certificate of Release or Discharge from Active Duty . Active duty members applying for a civil service position without submitting a valid certification memo or DD-Form 214 with their application will render the member ineligible for the position. The certification memo must originate from the member's military service branch on official letterhead and contain the following:
  • Name/Rank/Grade of Service Member
  • Branch of Armed Forces
  • Dates of Active Service (Start and End Date(s)
  • Expected Date of Discharge/Release from Active Duty
  • Terminal leave start date (if applicable)
  • Expected character of service/discharge and type of separation (i.e. separation or retirement)
  • Must be certified within 120 days of anticipated discharge
  • Signature by, or by direction of the adjutant, personnel office, unit commander, or higher headquarters commander
    NOTE: The VOW Act provides tentative preference. If appointed, a DD Form-214 must be submitted upon receipt.

    NOTICE OF VETERANS' PREFERENCE: There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Defense considers veterans' preference eligibility a positive factor for attorney hiring. Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation.

    NOTE: Applicants for attorney appointments do not require veterans' preference in order to be eligible for consideration.

DRUG-FREE WORKPLACE: The Defense Logistics Agency (DLA) has established a Drug-Free Federal Workplace Policy.
