Summary

OCR ensures EEO for the Department's employees and job applicants, non-discrimination and accessibility in Departmental programs, encourages resolution of disputes at the lowest level, and enhances awareness of the benefits of diversity of the Department's employees and customers. The incumbent will exercise forward-thinking and creativity to lead the Department in designing and implementing innovative programs to assess and improve EEO policies, processes, procedures, and systems

Responsibilities

The Director, OCR serves as the primary official and advisor to the CFO/ASA and DASA and other key officials on all aspects of equal opportunity, nondiscrimination, and civil rights. The Director, OCR also serves as a confidential source of information, advising on the manner in which programs are being implemented; advises on the impact of new regulations and policies; and represents the Department in coordinating activities with other agencies. In carrying out these responsibilities, the Director, OCR will:

Provide administrative direction and support in every area involving internal or external communications, including responses to customer, Congressional inquiries, FOIAs, the EEOC 462 Report, the MD-715 report, the No FEAR ACT report to Congress, the Age Discrimination Report, etc.

Develop, direct, and coordinate throughout the Department, programs, policies and activities to insure the effective fulfillment by the Department and all its element of its responsibilities involving federal employment of individuals with disabilities, anti-harassment program, reasonable accommodation program, barrier analysis focused on access to executive level positions, and compliance with EEOC's management directives.

Oversee the planning, development, and implementation of processes and procedures that tracks and monitors the status of Department programs and initiatives.

Prepare and manage the Department's response to various internal and external reports to include the gathering, consolidating, analyzing, and verification of data gathered; as well as the accountability for the Department's responses.

Develop program policy recommendations and monitor and evaluate the implementation of approved recommendations, ensuring Department programs are in compliance with EEO policy and regulation.

Advise and assist the operating units in the performance of their EEO and civil rights responsibilities.

Develop and administer evaluation programs to determine the effectiveness of all Department operating units in the area of EEO and civil rights; report the results of such evaluations to the head of the operating unit; and make recommendations for improvement including recommendations for corrective action by these officials.

Work closely with the Office of Human Resources Management, including as necessary establishing coordinating procedures and policy development, to insure unified implementation of Federal and Department requirements and programs.

Advise the Deputy Assistant Secretary for Administration and Chief Financial Officer and Assistant Secretary for Administration on any violations of Civil Rights or EEO statutes, Executive Orders, or regulations over which the Department has jurisdiction and for which legally sufficient corrective action has not been initiated, and recommend correction action.

Represent the Department and Deputy Assistant Secretary for Administration and the Chief Financial Officer and Assistant Secretary for Administration with other Federal agencies, including the EEOC, Department of Justice, Department of Health and Human Services, and Department of Labor, and with states, municipalities, labor unions and other public and private groups on matters concerning equal opportunity, nondiscrimination, and civil rights.

Maintain liaison with and solicit the views of organizations that advocate equality for persons with disabilities, minorities, women and other representative groups within and outside the Department on matters relating to civil rights and equal opportunity.

Develop statements of goals and periodic reports of achievements against the goals, for the responsibilities of the Office of Civil Rights.

Qualifications

To meet the minimum qualification requirements for this position, you must show that you possess all of the mandatory Executive Core Qualifications and Professional/Technical Qualifications listed. These qualifications would typically be acquired through education, experience, and training which reflect progressive development and achievement in leading and managing a comprehensive program in a complex organization. An individual's total experience must demonstrate the ability to perform the duties of the position. Applicants must meet all of the qualification requirements by the closing date of this announcement.

Additional information

Background Investigation: This position requires a Secret security clearance and is designated as critical-sensitive, requiring that a background investigation be conducted and favorably adjudicated in order to establish security eligibility.

Financial Disclosure: This position is covered under the Ethics in Government Act, which requires comprehensive financial disclosures from employees. The appointee will be required to file a Public Financial Disclosure Report (SF-278), within 30 days after his/her appointment, and then annually thereafter.

Qualifications Approval and Probationary Period: Persons newly selected for career appointment to the Senior Executive Service must have their executive core qualifications approved by an Office of Personnel Management Qualifications Review Board and will be required to serve a one-year probationary period.

Mobility: Individuals selected for Senior Executive Service positions may be subject to reassignment across geographical, organizational, and functional lines.

Drug Testing: Applicants tentatively selected for employment in any position are subject to designated and/or random pre-employment and employment urinalysis. Applicants who refuse to be tested will be denied employment and/or removed from employment with the Department of Commerce.

You will be evaluated for this job based on how well you meet the qualifications above.

All applicants will be evaluated by an Executive Resources Board (ERB) rating panel of senior managers to determine the degree to which they possess the mandatory executive core and professional/technical qualifications. The ERB rating panel will make recommendations on final selections to the appointing authority. PROFESSIONAL TECHNICAL QUALIFICATIONS (PTQs):

PTQ 1 -Demonstrated expert knowledge of EEO principles, laws and regulations, related personnel laws, and other current laws, statues and regulatory provisions relating to EEO, nondiscrimination, and civil rights, in order to lead the identification, assessment, and development of solutions to complex program matters.

PTQ 2 -Demonstrated knowledge of and experience in strategic and operational planning in order to administer major components of an EEO program (e.g. anti-harassment, disabilities, reasonable accommodation, barrier analysis, compliance, adjudication, advocacy or public policy), aligning programs and initiatives to the mission and fostering continued program improvements.

PTQ 3 -Demonstrated extensive experience in directing the development, implementation, and management of EEO/civil rights programs and initiatives that ensures unified execution of policies and procedures, attaining the goals and objectives of a large corporation, government organization, or similar entity.
