Summary

This position is located in the Department of Labor, Administrative Review Board. The incumbent of this position works in one of the three Adjudicatory Boards within the Office of the Deputy Secretary.

Responsibilities

Duties include but are not limited to:
  • Reviews incoming case files for completeness and content.
  • Studies each case and develops a detailed understanding of the background, nature of the appeal, and the rationale presented by the appellate and their attorney(s).
  • Locates and cross-references precedent case, underlying, applicable laws, and regulations, etc. needed to review each case and make determinations needed to grant or deny an appeal.
  • Researches and analyzes facts of the case.
  • Identifies and studies similar cases that might serve as/establish a precedent.
  • Documents research and findings to share with team/workgroup.
  • Prepares briefings, discussion papers, reports to inform judges, argue decisions, and substantiate findings.
  • Monitors and reports on the status and progress of work; review completed work to ensure instructions regarding work priorities, methods, deadlines, and quality are met.

Qualifications

Applicants must be at the time of hire a law school graduate who is a member in good standing of at least one state bar.

Minimum Qualification Requirement

For GS-11: In addition to the basic education requirement, candidates must possess at least one year of specialized experience and at least one year must be equivalent to the next lower grade level in federal service. Superior academic achievement or honors may substitute for one year of specialized experience.

The ARB will rate qualified applicants by comparing each candidate's qualifications to relative to the position requirements. ARB will consider relevant skills and experience, education and training, performance, and awards. The skills and experience listed immediately below are of particular importance to the position, and applicants should provide specific detailed information in these areas, where applicable, as part of their applications.

Specialized Experience: Is providing legal advice and support with regard to the areas of practice within the jurisdiction of the Board, including federal whistle-blower statutes, H-1B immigration provisions, child labor, employment discrimination, job training, seasonal and migrant worker regulations, and federal construction and service contracts.

Note: An LL.M may be substituted for a maximum of one year experience.

Education

Qualification for an Attorney, GS-0905-11 and above position requires a first professional law degree (LL.B or J.D).

You will be evaluated for this job based on how well you meet the qualifications above.

Applicants meeting the minimum qualification requirements for this position will be further evaluated against the following evaluation factors. Evaluation Factors:

1. Superior research and writing skills and extensive knowledge in one or more of the relevant areas of practice as described below are essential.

2. Prior experience as a law clerk or staff attorney to an appellate body, service on law review/journal, publication of an article or note in a legal periodical.

3. Honors/awards for academic or professional performance.

4. Demonstration of good judgement, sound reasoning, and critical thinking.

5. Ability to make effective oral presentations in a clear and concise manner.

6. Ability to establish and maintain effective liaison with high level departmental officials, regional program officials, supervisors, agency staff and the general public.

7. Ability to multi-task in a complex and fast-paced inter-disciplinary legal environment, entailing timely collections of facts, identification and resolution of issues, enumeration of options, and formulation of recommendations.
