Summary

The incumbent serves as the Assistant General Counsel (AGC) for Regulatory Services for the Division of Regulatory Services (DRS, or Division) within the Ethics, Legislative, and Regulatory Services Deputyship of the U.S. Department of Education's (Department) Office of the General Counsel (OGC). The incumbent develops policies relating to, coordinates, and monitors the Department's regulatory process.

Responsibilities

The Assistant General Counsel for Regulatory Services oversees the key managerial and leadership responsibilities in assigning, directing, and overseeing the work of DRS attorneys, support staff, and other personnel. The incumbent will be responsible for the following duties and responsibilities:

Providing policy guidance and legal advice regarding the review and promulgation of the Department's regulations, including complex regulations to carry out major initiatives of the Administration and the Department.

Establishing policy for, and directing, the development of regulations, including regulations to carry out major initiatives of the Administration and the Secretary.

Regularly monitors and manages the implementation of assignments, including increasing or decreasing the volume and complexity of the Division's workload.

Performing special assignments for the General Counsel or other Deputy General Counsels which may be novel in approach and cut across various components of the Office of the General Counsel.

Qualifications

EXECUTIVE CORE QUALIFICATIONS (ECQs): Unless you are currently under a career SES appointment, are eligible for reinstatement into the SES, or have successfully completed an SES Candidate Development Program approved by OPM, you must submit written statements (narrative format) describing accomplishments that would satisfy the ECQs. If you fail to do so, you will be rated as 'ineligible'. You must limit your narrative to two (2) pages per ECQ. When uploading your ECQs, choose the Supporting Document Type called ECQ.

ECQ 1 - Leading Change: This core qualification involves the ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.

ECQ 2 - Leading People: This core qualification involves the ability to lead people toward meeting the organization's vision, mission, and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts.

ECQ 3 - Results Driven: This core qualification involves the ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.

ECQ 4 - Business Acumen: This core qualification involves the ability to manage human, financial, and information resources strategically.

ECQ 5 - Building Coalitions: This core qualification involves the ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

MANDATORY TECHNICAL QUALIFICATIONS (MTQs): All applicants must submit written statements (narrative format) of accomplishments that would satisfy the technical qualification. You must address each technical qualification separately. You must limit your narratives to two (2) pages per technical qualification. When uploading your MTQs, choose the supporting Document Type called MTQ.

MTQ 1: Demonstrated skill and ability in Federal rulemaking law, other administrative law, constitutional law, and other laws governing or affecting development of regulatory documents.

MTQ 2: Demonstrated experience in applying legal knowledge through executive-level legal counseling.

MTQ 3: Demonstrated skills in legal advocacy and representing clients.

When responding to the MTQs and ECQs, you must clearly show that you possess the experience, knowledge, skills and ability to perform the duties of this position by submitting narrative responses in which you detail your experience in each of the ECQs and MTQs.

Your examples should be clear and emphasize your level of responsibilities, scope, and complexity of the programs managed and program accomplishments with results of your actions, policy initiatives and level of contacts.

Education

You must possess a J.D. or LL.M from a law school accredited by the American Bar Association and be a member in good standing of a bar in a state/territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

In lieu of the narrative statement, current career SES members, reinstatement eligibles, and SES Candidate Development Program graduates must provide the documentation in item #5. ECQs should not exceed ten (10) pages total.

4. Bar Status: Proof of admission to the Bar of the highest court of a state, territory, the District of Columbia, or the Commonwealth of Puerto Rico; and must be a current member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.

5. Current and former career SES members must provide an SF-50, Notification of Personnel Action documenting their status or reinstatement eligibility). Candidates who have successfully completed an Office of Personnel Management approved SES Candidate Development Program must submit a copy of their ECQ certification.
