NOTE: This vacancy announcement may be used to fill the Senior Executive Service (SES) position of Deputy Chief, Law Enforcement Operations, ES-1896, in the U.S. Border Patrol, for a period of 12 months from the closing date of the vacancy announcement. The U.S. Border Patrol is the primary federal law enforcement organization responsible for preventing the entry of terrorists and their weapons from entering the United States between official Customs and Border Protection (CBP) ports of entry. The Border Patrol's traditional mission is to enforce immigration laws and to detect, interdict, and apprehend those who attempt to illegally enter or smuggle people or contraband across U.S. borders between official ports of entry and to prevent the entry of terrorists and weapons of terrorism. Border Patrol enforces the laws that protect America's homeland through the detection, interdiction, and apprehension of those who attempt to illegally enter or smuggle any person or contraband across our Nation's border.

As Deputy Chief, Law Enforcement Operations, in the Border Patrol, you will work closely with the Chief, Law Enforcement Operations. You will be responsible for planning, organizing, prioritizing, managing, and directing all phases of the Border Patrol's programs relating to: the detection and prevention of terrorists and weapons of mass destruction;
the smuggling and illegal entry of aliens; illegal importation of contraband and narcotics;
the apprehension of offenders; and the enforcement of criminal and other provisions of the Immigration and Nationality laws across our Nation's border.

You will plan, direct, and implement all facets of the Border Patrol's programs and related activities within the framework of broad CBP program objectives and goals. You will continuously develop modifications to techniques and methods to ensure that the mission and the basic responsibility of the U.S. Border Patrol are carried out at our Nation's borders. You will oversee subordinate supervisors and coordinate the deployment of necessary resources to effect border operations.

You will serve as an advisor to CBP and Department of Homeland Security officials on border program matters, and make recommendations for changes or revisions in overall program policies and practices or other such matters as may be required to produce the most effective management of the Border Patrol functions.

Technical Qualification - Mandatory

Expert knowledge of federal laws, rules, and regulations related to border patrol operations (e.g., detection, apprehension, and deterrence of terrorists and their weapons, illegal immigrants, and contraband entering the United States).

Additional information

Relocation Bonus: CBP may authorize a relocation bonus (not to exceed 25% of basic pay) for an eligible selectee. A service agreement is required.

Travel: Overnight travel may be required on a regular and recurring basis.

Background Investigation: This is a sensitive position and the tentative selectee must undergo and successfully complete a background investigation as a condition of placement/retention in the position. A security clearance is required.

Drug Testing: This position has been identified as a Testing Designated Position under the CBP Drug-Free Workplace Program. Satisfactory completion of the drug test is a condition of placement and/or employment in the position and the incumbent(s) of this position is thereafter subject to Random Drug Testing.

Probationary Period: You will serve a one-year probationary period unless you previously completed the probationary period in the SES.

Spanish Language Requirement: Proficiency in speaking the Spanish language is required.

Law Enforcement Retirement: This position will carry secondary law enforcement coverage as provided in 5 U.S.C. 8336(c), and 5 U.S.C. 8412(d), for eligible law enforcement employees. Employees who reach age 57 with at least 20 years of creditable service under law enforcement provisions are subject to mandatory separation from this position. Federal employees who currently work in a primary/rigorous law enforcement position and do not have a break in service of more than three days are eligible to continue coverage in a secondary position.

Financial Disclosure: If you are hired, you will have to complete a Public Financial Disclosure Report within 30 days after appointment.

Lautenberg Amendment: This position authorizes the incumbent to carry a firearm. Any person who has been convicted of a misdemeanor crime of domestic violence cannot lawfully possess a firearm or ammunition [TITLE 18, U.S.C., SECTION 922(G)(9)]. A "misdemeanor crime of domestic violence" is generally defined under the statute as any offense involving the use or attempted use of physical force, or the threatened use of a deadly weapon, committed by the victim's current or former domestic partner, parent, or guardian. The term "convicted", as defined in the statute, excludes any person whose conviction has been expunged, set-aside, or pardoned or any person whose civil rights have been restored unless the pardon, expungement or restoration of civil rights expressly prohibits the possession of firearms or ammunition. Candidates who have been convicted of a misdemeanor crime of domestic violence within the meaning of the referenced statute are not qualified for this position. Candidates under consideration will be required to certify whether they have ever been convicted of such an offense. False or fraudulent information provided by candidates is criminally punishable by fine or imprisonment (TITLE 18, U.S.C., SECTION 1001).

You will be evaluated on the quality and extent of your total accomplishments, experience, and education. Your résumé will be evaluated by a rating and ranking panel, and highly qualified candidates may undergo an interview and a reference check. The U.S. Customs and Border Protection Executive Resources Board (ERB) will review results and make recommendations on final selections to the appointing authority. Unless you have already been certified by a Qualifications Review Board (QRB) in the past, your ECQs must be certified by a QRB before appointment can occur.
