Duties

Summary

As General Counsel, you are the chief legal officer and advisor to the Board. You are responsible for directing the operations of the OGC; conducting all Board hearings and court litigation; reviewing all Board documents for legal sufficiency; and enforcing the applicable sections of the Atomic Energy Act of 1954 (as amended), and other relevant statutes. You will represent the Board before Congressional Committees in meetings. In addition, oversee the Board's Ethics and ADR programs.

Responsibilities

  • Provides expert advice and counsel to the Board on legal, ethical, and policy questions arising from the conduct of Board activities; advises the Board on procedural and substantive questions of law. Formulates and recommends the Board's position regarding difficult and complex legal problems and issues that may be controversial and of significant public interest.
  • Investigates, participates in investigations, and reports to the Board on investigations. Jurisdictional questions may involve a broad variety of questions of interpretation of state or Federal statutes, and legislative history. Assists Board Members in conducting public hearings.
  • Prepares regulations on behalf of the Board; reviews, analyzes, and reports to the Board on proposed legislation and bills passed by Congress. Represents the Board before Congressional committees in meetings on proposed legislation and other matters and in investigations.
  • Directs, coordinates, and reviews the preparation of opinions, memoranda, reports, recommendations, briefs and other documents for the Board on a wide variety of subjects, including: matters of civil, criminal, and administrative law, policy, and procedures under the statutes governing and administered by the Board; and, legal questions arising from the relations between the Board, other Federal agencies, and the public.
  • Ensures Board compliance with Federal laws and regulations in a variety of areas, including openness in Government law, administrative law, privacy and information law, ethics law, procurement law, appropriations law, and employment law.
  • Represents the Board in suits in U.S. District Courts to enforce compliance with the Board's rules and regulations, and subpoenas; represents the Board in the U.S. Court of Appeals on appeals from suits in District Courts related to these matters. In association with the Department of Justice, prepares all necessary documents for proceedings before the United States Supreme Court.

You are required to respond to each of the ECQs. If you fail to do so, you will be rated as "ineligible." The narrative statement for your ECQs should not exceed 10 total pages and should be prepared in at least 11-point font.

Qualifications

To meet the minimum qualification requirements for this position, you must show you possess the five mandatory Executive Core Qualifications (ECQs) and mandatory Technical Qualifications listed below. Please provide this information in the order the elements are presented.

Executive Core Qualifications: All applicants must submit written statements (narrative format) describing accomplishments that would satisfy the ECQs. Each accomplishment should be clear, concise, and emphasize your level of responsibilities, the scope and complexity of the programs managed, and the results of your actions. You must address each ECQ separately. Applicants already serving in SES career appointments, eligible for reinstatement to the SES, or who have successfully completed an SES Candidate Development Program may omit the Executive Core Qualifications. However, they must provide the following additional documentation as part of their application:
  • Applicants in a Career SES position or those eligible for reinstatement to a Career SES position must include a copy of Standard Form 50, Notification of Personnel Action, documenting their SES career appointment.
  • Mandatory Technical Qualifications: All applicants must submit a written statement (narrative format) of accomplishments to satisfy the Mandatory Technical Qualifications (MTQ). You must address each MTQ separately. The narrative statement for your MTQs should not exceed two (2) pages for each technical qualification (a total of 8 pages) and should be prepared in at least 11-point font.


Education

All applicants must possess a law degree (J.D. or LL.B.) from a law school accredited by the American Bar Association and be a member in good standing of the bar of a state, U.S. territory, the District of Columbia, the Commonwealth of Puerto Rico, or a Federal court of general jurisdiction. In addition, at least 5 years of post J.D. legal experience is required.

Veterans' preference does not apply to the Senior Executive Service.

Prior to appointment, applicants are required to undergo screening for illegal drug use. After employment, individuals are subject to random drug testing.

This is a Career General position in the SES. As a condition of employment, the individual selected will be required to enter the SES, if not already a member, and have his or her ECQs approved by an OPM Qualifications Review Board. New career appointees to the SES will be required to serve a 1-year probationary period. Upon completing the required probationary period, the position will be permanent.

The selectee must file an Executive Branch Personnel Disclosure Report, SF 278, upon entering the position and each year thereafter.

Security/Suitability. The selectee will occupy a Critical Sensitive position requiring a background investigation leading to the granting of a "Q" level security clearance. Applicants are required to obtain and maintain a "Q" level security clearance.

Some travel is required.

How You Will Be Evaluated

You will be evaluated for this job based on how well you meet the qualifications above.

Applicants will be screened for basic eligibility according to the ECQs and Mandatory Technical Qualifications, and will be rated and ranked by a panel using only the information submitted in their application package. Failure to document demonstrated experience, training, and education in support of the ECQ's and Mandatory Technical Qualifications will adversely affect your chances for further consideration. The best qualified applicants will be referred to the selecting official. If a selection is made, the selecting official will base the selection on the information submitted in the application package, and possibly a personal interview.   • Demonstrated executive management and legal experience managing a legal office comprised of professional and support staff engaged in a wide range of legal issues such as administrative law, fiscal law, ethics law, procurement law, privacy and information law, employment law, and other legal matters related to Federal agency practice.
  • Demonstrated experience in negotiating, drafting and reviewing policies, procedures and agreements and rendering legal advice and opinions to senior officials on a broad spectrum of complex governmental and/or corporate issues.
  • Demonstrated experience in executive level communications including negotiating and persuading to gain consensus under difficult, complex legal circumstances. This includes the ability to work with a wide variety of people, effectively communicate progress on a regular basis, and gain buy-in at cross-organizational levels towards a common goal.
  • Demonstrated experience in strategic planning and implementation, use of "best practices" methods to support organizational cultural change, innovative training and education for legal professionals and support staff.

5. A copy of your most recent supervisory performance appraisal or equivalent.
