Summary

The primary purpose of this position is to serve as a Program Specialist within the Appellate Operations Division, Case Intake Section ensuring performance and compliance with agency regulations and procedures, program directives, and technical requirements to ensure efficient and effective program management of cases in preparation for timely and high-quality hearings and appeals decisions.

Responsibilities

The incumbent evaluates and coordinate quality reviews on evidentiary development of records
and outside medical opinions, to ensure accurate, complete, adequate, and appropriate support
for Board Members and Decision Team Counsel decisions.

Serve as an expert technical advisor and/or consultant, preparing briefing documents, as well as
answering Congressional and other stakeholder inquiries pertaining to case intake.

Prepare a variety of substantive documents to include memoranda, reports, discovery requests,
and documentation relevant to acquiring evidence or testimony received from claimants, service
organizations, Members of Congress, attorneys, etc., concerning questions pertaining to the
various benefits administered by the Department of Veterans Affairs.

Conduct legal research and fact finding to identify deficiencies in due process and determine
whether factual or legal errors were made in appeals decision issued by the Board.
Identifies ambiguous requests and clarifies all such requests with the appropriate Board Member
or Decision Team Counsel.

Superior interpersonal and managerial skills to organize, coordinate, action plans, and resolve
complex issues which are often divisive through systematic, professional interactions.

Analyze facts and legal issues, and prepare appropriate memorandum, discussion paper, brief or
report reflecting facts, supporting case law, applicable regulations, sources, and other items
discovered during the course of legal research.

Incumbent prepares written certified list s for the designation of record (DOR) concerning Board
decisions appealed to the U.S. Court of Veterans Appeals for Veterans Claims (CAVC). This
includes reviewing the appealed Board decision in conjunction with the appellant's claims file to
identify tab, describe, and list relevant evidence that the Board relied upon in rendering its
decisions.

Prepares both complex non-routine correspondence for reconsideration of Board decisions,
independent medical expert opinion cases, and withdrawal of appeals.

Incumbent collaborates with accredited service organizations, attorneys, representatives,
adjudication officers, veteran's benefits counselors, and appropriate hospital personnel to
research complex questions relevant to appeals pending before the Board, in order to facilitate
due process.

Provides accurate information regarding the appellate process to White House Officials,
Members of Congress, appellants, accredited representatives and other interested parties
concerning appeals pending before the Board or final BVA decisions.

Analyses decisions and makes final consideration in conjunction with correspondence to
determine whether there is substance to complaints or questions as to warrant recall of the record
for further study.

Composes original correspondence in response to inquiries or takes other administrative action
as required. Initiates telephone contact with appropriate personnel in field offices to obtain
information required giving an accurate and fully reply to Members of Congress and other
authorize, interested parties.

Serves as the principle assistant to the Board member in hearings before the Board, reviews and
analyzes hearing related motions and requested filed under 38 C.F.R. §§ 20.702.

Accurately stores files according to type of case and stage of process. Maintains case files in
proper category and order. Distributes cases to appropriate employee/location and charges files
to designated location.

Routinely conducts quality reviews of work products; notes technical errors; and provides
instructions for correcting deficiencies. Incumbent also conducts routine and non-routine
analysis and provides recommendations to eliminate deficiencies in the administrative process.

Distributes cases that have been advanced on the Board's docket or require special handling to
designated team employees to facilitate requested action.

Monitors production levels and provides daily production report. Furnishes statistical data a
necessary in make in daily, weekly, and month reports for use by the Board's Leadership Team
to monitor the productivity of the Board's caseloads.

Promotion Potential: The selectee may be promoted to the full performance level without further competition when all regulatory, qualification, and performance requirements are met. Selection at a lower grade level does not guarantee promotion to the full performance level.

Qualifications

To qualify for this position, applicants must meet all requirements by the closing date of this announcement, 10/16/2019.

Time-In-Grade Requirement: Applicants who are current Federal employees and have held a GS grade any time in the past 52 weeks must also meet time-in-grade requirements by the closing date of this announcement. For a GS-07 position you must have served 52 weeks at the GS-05. The grade may have been in any occupation, but must have been held in the Federal service. An SF-50 that shows your time-in-grade eligibility must be submitted with your application materials. Note: Time-In-Grade requirements also apply to former Federal employees applying for reinstatement as well as current employees applying for Veterans Employment Opportunities Act of 1998 (VEOA) appointment.

You may qualify based on your experience and/or education as described below:
  • Specialized Experience: You must have one year of specialized experience equivalent to at least the next lower grade GS-05 in the normal line of progression for the occupation in the organization. Examples of specialized experience would typically include, but are not limited to: demonstrated experience in providing administrative services pertaining to case file review and processing of legal documents; utilizing various software applications to review, edit and maintain legal documents; and preparing letters, and performing research analyses to support legal document development and dissemination. OR,
  • Education: Applicants may substitute education for the required experience. To qualify based on education for this grade level you must have . OR,
  • Combination: Applicants may also combine education and experience to qualify at this level. You must have an combination of specialized experience and education beyond I have 1 full year of graduate level education or superior academic achievement.
