Summary

The incumbent will serve as a Deputy Associate General Counsel for the General Law Division, Office of the General Counsel for the U.S. Department of Homeland Security (DHS). The General Counsel, appointed by the President with the advice and consent of the Senate, is the Department's chief legal advisor and principal legal advisor to the Secretary of Homeland Security and, as such, has final authority and responsibility for legal policy determinations within the Department and its components.

Responsibilities

Deputy Associate General Counsel for General Law provides legal advice and guidance on labor and employment law, including legal actions before the Merit Systems Protection Board, Equal Employment Opportunity Commission, and Office of Special Counsel; administrative law, including environmental issues, real property matters, the Federal Tort Claims Act; the Federal Records Act; the Federal Vacancies Reform Act; and the Federal Advisory Committee Act; the activities of the Board for Correction of Military Records of the Coast Guard; and advice for the Secretary, Deputy Secretary, and senior DHS officials in the exercise of their responsibilities and authorities under the U.S. Constitution and applicable statutes and regulations.

The incumbent is responsible for:

· Supporting the General Counsel, Deputy General Counsel and the Associate General Counsel for General Law in providing legal advice on General Law Division matters to the Secretary, Deputy Secretary, Under Secretary for Management, and DHS Headquarters offices.
· Supporting the Associate General Counsel in, and sharing in the responsibility for, managing and directing Division staff, including managing 45 supervisory and staff attorneys.
· In conjunction with the Associate General Counsel, the Deputy Associate General Counsel for Acquisition and Procurement Law, and the Assistant General Counsel for Appropriations and Fiscal Law, overseeing the provision of legal guidance and counsel on all general law issues to the DHS headquarters offices and by the legal offices within the various operational components of the Department.
· Overseeing and managing litigation support to the Department of Justice and United States Attorneys in representing the Government's interest in Federal court on employment and labor matters, Federal Tort Claims Act matters and environmental law matters; and the representation of DHS in administrative litigation before the Equal Employment Opportunity Commission, Federal Labor Relations Authority, Merit Systems Protection Board, Office of Special Counsel, and arbitrators in cases arising out of the Headquarters Office.
· Managing administrative and personnel matters for the Division, including monitoring Division workloads and resources, making recommendations on resource needs and allocation, and making recommendations on personnel actions.

Qualifications

As a basic requirement for entry into the SES, applicants must provide evidence of progressively responsible leadership experience that is indicative of senior executive level management capability and directly related to the skills and abilities outlined under the Technical Qualification(s) and Executive Core Qualifications listed below. Typically, experience of this nature will have been gained at or above the GS-15 grade level in the federal service or its equivalent in the private sector.

To meet the minimum qualification requirements for this position, you must show that you possess the five Executive Core Qualifications (ECQs) and the Technical Qualification(s) listed below. We recommend that your résumé and ECQ responses emphasize your level of responsibilities, the scope and complexity of programs managed, and your program accomplishments, including the results of your actions.

Technical Qualifications - Mandatory

You will be evaluated on the following Technical Qualifications:

TQ-1: Experience in providing legal advice to the private sector or to government entities concerning some or all of the following General Law Division issues: significant Constitutional issues of first impression, federal court or administrative litigation, labor and employment law, administrative law, and environmental law.

TQ-2: Demonstrated management ability involving both legal and administrative matters in an agency, law firm, or other organization. Candidates should demonstrate the ability to work with legal and other professionals to evaluate and develop policies, procedures, and objectives for an organization. Candidates also should demonstrate the ability to generate and review outstanding written legal work product under tight deadlines.

FAILURE TO MEET OR FULLY ADDRESS EACH MANDATORY EXECUTIVE CORE AND TECHNICAL QUALIFICATIONS WILL ELIMINATE A CANDIDATE FROM FURTHER CONSIDERATION.

A Juris Doctorate (JD) from an accredited institution is required for this position.

You must possess a law degree from an accredited law school and be an active member in good standing of the bar of the highest court of any state, territory, Commonwealth, or the District of Columbia, and must not be under any order of any court suspending, enjoining, retraining, disbarring, or otherwise restricting you in the practice of law.

How You Will Be Evaluated

You will be evaluated for this job based on how well you meet the qualifications above.

You will be evaluated on the quality and extent of your total accomplishments and experience. Your resume, ECQ and TQ narrative statements will be evaluated by an SES rating and ranking panel, and afterwards highly qualified candidates will be referred to the selecting official. The DHS Executive Resources Board (ERB) will review results and make recommendations on final selections to the appointing authority where final interviews and reference checks may occur. Unless you have already been certified by the Office of Personnel Management (OPM) Qualifications Review Board (QRB) in the past, your ECQs must be certified by an OPM/QRB before appointment can occur.
