Summary

The Associate Deputy Assistant Secretary (ADAS) reports directly to the Deputy Assistant Secretary (DAS) for Anti-Dumping (AD) and Countervailing Duty (CVD) Operations in the Enforcement and Compliance (E&C) business unit within the International Trade Administration. The ADAS is responsible for providing expert counsel and oversight on methodological and policy issues pertaining to all AD/CVD proceedings. The ADAS is the DAS' primary advisor for all AD/CVD proceedings.

Responsibilities

The ADAS for AD/CVD Operations participates in the development of the organization's operating policies, program initiatives, and objectives. The incumbent also advises and recommends adoption of specific actions as they relate to the ongoing AD/CVD cases and litigation. The ADAS serves as Acting DAS for AD/CVD Operations in his/her absence. Through multiple offices, including two SES Directors, the ADAS assists the DAS in managing the accomplishment of the following:
  • Directs work related to: the analysis of AD/CVD petitions submitted by domestic manufacturers, producers and trade associations alleging unfair trading practices and recommends appropriate courses of action; conduct of AD/CVD investigations resulting from such petitions during which the practices of foreign businesses and governments are queried and investigated; issuance of orders subjecting imports to offsetting duties when dumping and injury is found; conduct of reviews (including administrative, sunset, and new shipper reviews,) and existing AD/CVD orders; recommendation of revocation, termination or extension of existing AD/CVD orders; and preparation of instructions to the U.S. Customs Service regarding the collection of duties on outstanding orders.
  • Provides support to the DAS for AD/CVD Operations, the DAS for Policy and Negotiations, and the Chief Counsel for Trade E&C to support the negotiations of AD/CVD suspension agreements and other sector agreements.
  • Manages and coordinates AD/CVD enforcement efforts to ensure consistent application of laws, regulations and precedents across the DAS group of offices and promote and ensure consistency in all aspects of the administration of the AD/CVD program; coordinates cross-cutting functions such as scope determinations, U.S. Customs protests, and training; and completes all E&C reporting and accountability requirements.
  • Serves on various executive/managerial working groups, committees, and panels as a senior ITA official, and may also assume special program responsibility for or other major initiatives critical to E&C and/or ITA advancement.
  • Responsible for strategic planning and the development of operating and program policies specifically applicable to the subordinate organizations.
  • Accountable for assisting in managing an organization with at least two subordinate SES positions and over 170 positions; all budget and fiscal management responsibilities within delegated authorities, encompassing broad financial planning, budget formulation and development, financial management and control strategies, use of ITA systems and controls to monitor utilization of fiscal resources, modifying budgets and spending plans in response to external decisions or events, and properly completing all relevant reporting and accountability requirements.

Professional Technical Qualifications
  • Demonstrated experience in interpreting complex statutes, regulations, policies and procedures related to the administration of the antidumping and countervailing duty (AD/CVD) program, as set forth in the Tariff Act of 1930, as amended; demonstrated ability to interpret complex statutory and regulatory guidance related to import programs, policies, issues and problems; and demonstrated ability to collaborate and provide input on major policy initiatives.

    2. Demonstrated experience in the relative roles, responsibilities, and operations of Federal agencies involved in the trade remedy area.

    3. Demonstrated experience communicating and collaborating with senior level officials of the U.S. and foreign governments, including ambassadors; senior management officials of domestic and foreign industries; executive level representatives of trade associations; and other high-ranking individuals on sensitive issues associated with AD/CVD proceedings.

    Executive Core Qualifications
    The following are the five ECQs and their fundamental competencies which are the primary selection criteria for SES positions. The ECQs were developed to assess executive experience and potential, not to evaluate technical experience.     Additional information

    Background Investigation/Clearance: This position is designated as critical-sensitive and requires a Top Secret clearance.
    Financial Disclosure: This position is covered under the Ethics in Government Act, which requires comprehensive financial disclosures from employees. The appointee will be required to file a Public Financial Disclosure Report (SF-278), within 30 days after his/her appointment, and then annually thereafter.
    Qualifications Approval and Probationary Period: Persons newly selected for career appointment to the Senior Executive Service must have their executive core qualifications approved by an Office of Personnel Management Qualifications Review Board and will be required to serve a one-year probationary period.
