You will serve as the General Counsel for Defense Health Agency (DHA) in the Office of the Assistant Secretary of Defense for Health Affairs (OASD(HA)), Office of the Under Secretary of Defense for Personnel and Readiness (OUSD(P&R)). DHA leads the military health system (MHS) in delivering health services to 9.4 million beneficiaries in military hospitals and clinics around the world and, through the TRICARE health plan, administers a budget in excess of $50B annually.

  • You will report to the DoD Deputy General Counsel (Personnel and Health Policy), who exercises authority, direction, and control on behalf of the DoD General Counsel/Director, Defense Legal Services Agency.
  • You will oversee the delivery of legal services by the DHA Office of General Counsel (OGC), a large, decentralized legal office, and serve as legal advisor to the DHA Director and his/her executive management team, market managers.
  • You will manage the operations of the DHA OGC, composed of over 70 legal professionals assigned throughout the United States and oversee the delivery of legal services and support by DHA OGC.
  • You will perform difficult legal work involving complex business/policy matters of national significance related to the Military Health System, the TRICARE Program, and the administration and management of military treatment facilities.
  • You will perform difficult legal work involving complex business/policy matters of national significance related to joint DoD/Department of Veterans Affairs (VA) strategic acquisitions and implementation of DoD-VA integrated electronic health record.
  • You will perform difficult legal work involving complex business/policy matters of national significance related to resource sharing projects with Federal Agencies and multi-million/billion dollar programs impacting large population segments.
  • You will draft, interpret or apply legislation, regulations, contracts, orders, agreements, public-private partnerships, decisions, opinions, or other legal instruments.
  • You will have to perform with a high degree of legal sophistication to obtain a reasonable balance of conflicting interests and proper mitigation of risks.
  • You will advise on the interpretation and application of Federal and state laws and DoD Directives and policies related to the TRICARE Program including on issues such as TRICARE beneficiary eligibility and coverage and Medicare reimbursement.
  • You will advise on the TRICARE Civil Monetary Penalties Program.
  • You will provide health law advice on: medical malpractice cases; quality assurance and risk management matters, including credentialing, privileging, adverse privileging, and reports to the National Practitioner Data Bank.
  • You will provide health law advice on: bioethics; medicolegal matters; human subjects research; and informed consent.
  • You will oversee OGC's Contract Law Division and advises DHA leaders on all acquisition program and contracting matters.
  • You will ensure that acquisition decisions and contracting actions are executed in a manner consistent with applicable law, acquisition regulations, Departmental policies, Comptroller General decisions, and court precedents.
  • You will provide advice in the areas of fiscal law; information and privacy law including: cyber security and Federal records management; inter-agency support agreements; conference approval; and False Claims Act matters.
  • You will provide expert advice regarding Federal sector employment laws and regulations, including employee relations, performance management, staffing, classification, pay, benefits, workforce reshaping and equal employment.
  • You will evaluate and recommend changes in the regulatory debt collection program and implementing TRICARE policy guidance as necessary to ensure enforcement of the Federal government's rights to collect debts while ensuring due process for debtors.
  • You will serve as DoD's senior legal advisor regarding inter-agency health information technology initiatives, including the creation and sustainment of a single, seamlessly integrated electronic health record for DoD and VA.
  • You will serve as the Deputy Designated Agency Ethics Official (Deputy DAEO) for all personnel assigned to the DHA with the authority and responsibilities of a DAEO.
  • You will perform Deputy DAEO responsibilities pursuant to the Ethics in Government Act and Ethics Reform Act and in conformance with applicable ethics laws, Standards of Ethical Conduct for Employees of the Executive Branch, and DoD regulation.

  • This position may require travel from normal duty station to CONUS and OCONUS and may include remote or isolated sites. You must be able to travel on military and commercial aircraft for extended periods of time.

MANDATORY TECHNICAL QUALIFICATIONS: (Each must be addressed separately in your Supplemental Narrative Statement. Each MTQ must not exceed 2 pages.)

1. Demonstrated ability to manage a large, decentralized law office and effectively supervise the work of attorneys and support staff, including the ability to plan, direct, budget for, and control the technical and administrative operations of a legal office consisting of approximately 75 attorneys, paralegals, and support staff that handle a broad, diverse portfolio of legal practice areas.

2. Demonstrated thorough knowledge of Federal governmental operations and processes and the organizational structure and authorities of the Office of the Secretary of Defense and the Military Departments.

3. Demonstrated extensive knowledge of Department of Defense (DoD) military and civilian health care activities and inter­agency relations related to health care delivery and military medical readiness.

4. Sufficient legal expertise and senior level leadership skills to enable agile and effective handling of complex legal-policy issues in the absence of clearly defined precedents and in an ambiguous and complex military healthcare environment undergoing radical organizational transformation.
