Summary

This position is located in the Department of Labor (DOL), Mine Safety and Health Administration (MSHA), Office of Standards, Regulations and Variances (OSRV), Regulatory Development Division. The incumbent performs a wide variety of assignments that support activities related to the development and promulgation of MSHA's standards and regulation.

Responsibilities

At the GS-09 level, the incumbent, is responsible for performing a variety of assignments including, but not limited to, the following: conduct research required for background information; develop and analyze material used for proposed regulatory actions; provide assistance with organizing and updating rulemaking dockets; provide assistance in preparing certified indexes for the court; the development of materials used in public meetings and hearings with the mining community; assist with the review and analysis of comments received on proposed rulemaking; and assist with formulating MSHA' s responses to comments; prepare answers to questions and/or other correspondence received as a result of the proposed rules and rulemaking procedures.

At the GS-11 level, the incumbent, is responsible for performing a variety of assignments including, but not limited to, the following: performs research for required background information for proposed regulatory actions; develops and analyzes materials used to develop proposed rulemakings; collaborates with senior regulatory specialists to coordinate work products with the Office of the Solicitor and Departmental personnel to ensure that proposed regulations meet all legal requirements; represent MSHA in meetings with representatives of private industry and organized labor to discuss and/or gain acceptance of Agency proposals and/or to ensure full input in the regulation development process; prepares answers to questions and/or other correspondence received as a result of the proposed rules and the rulemaking procedures; Responsible for reviewing proposed Agency policy issuances to ensure that they are consistent with MSHA goals and objectives.

At the GS-12 level, the incumbent, is responsible for performing a variety of assignments including, but not limited to, the following: Review and formulate policy issuances; prepares reports and statements required by law, Executive Order or regulation, and developing regulations; conducts reviews and analysis of existing Agency regulations to identify those which may need revision in view based on changing Agency requirements, policies or actions taken by other regulatory agencies; drafts complex, controversial and/or sensitive regulations; assist personnel from the Office of the Solicitor in drafting regulations; responsible for determining if proposed regulations or standards require regulatory and environmental impact analyses; prepares answers to questions and/or other correspondence received as a result of the proposed rules and rulemaking procedures.

At the GS-13 level, the incumbent, is responsible for performing a variety of assignments including, but not limited to, the following: review and formulate policy issuances, preparing reports and statements required by law, Executive Order or regulation, and developing regulations; conducts reviews and analyses of existing Agency regulations to identify those which may need revision in view of changing Agency requirements, policies, or actions taken by other regulatory agencies; drafts the complex, controversial, sensitive regulations and/or assists personnel from the Office of the Solicitor in drafting regulations; reviews proposed Agency policy issuances to ensure that they are consistent with MSHA goals and objectives; responsible for determining if proposed regulations or standards require regulatory and environmental impact analyses; exercises a leadership role to resolve any differences within MSHA or between MSHA and outside entities; prepares answers to questions and/or other correspondence received as a result of the proposed rules and rulemaking procedures.

Qualifications

All positions will require you to communicate orally and in writing. All writing must use proper grammar and punctuation. Grade level specialized experience is outlined below:

Specialized Experience

To qualify for the GS-09, Two full years of progressively higher level graduate education leading to such a degree or LL.B. or J.D., if related Ph.D. or equivalent doctoral degree. -OR- applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-07, in the Federal Service. Examples of specialized experience will include the following: (1) Perform research and fact-gathering assignments for proposed rulemakings; (2) Develop and analyze data from a wide-range of sources for proposed rulemaking and other policy-related actions; (3) Assist in the development of materials used in public meetings and hearings with the mining community; (4) Assist in the review and analysis of comments received on proposed rulemaking; (5) Assist with organizing and updating the rulemaking docket; and (6) Assist senior regulatory specialists in developing responses to questions from Congress and the mining community.

To qualify for the GS-11, Three full years of progressively higher level graduate education leading to such a degree or LL.M., if related. -OR- applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-09 in the Federal Service. Examples of specialized experience will include the following: (1) Review existing Agency standards and regulations to identify those that need to be updated; (2) Assist in drafting background information and other preamble language for proposed rulemakings; (3) Work with senior regulatory specialist to ensure that the Agency's rulemakings meet all legal requirements; (4) Review and analyze comments received on proposed regulations and determine, in conjunction with the senior OSRV staff and program personnel, if issues raised by commenters warrant changes to the proposed rulemaking; (5) Assist senior regulatory specialist in preparing answers, reports and statements to questions and/or other correspondence received as a result of the proposed rules; and (6) Assist with organizing and updating the rulemaking docket.

To qualify for the GS-12, applicants must have 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-11, in the Federal Service. Examples of specialized experience will include the following: (1) Conduct continuous reviews of existing standards and regulations to identify those that need to be updated; (2) Draft background information and other preamble language for proposed rulemakings; (3) Work with senior regulatory specialist to ensure that the Agency's rulemakings meet all legal requirements; (4) Review and analyze comments received on proposed regulations and determine, in conjunction with the senior OSRV staff and program personnel, if issues raised by commenters warrant changes to the proposed rulemaking; (5) Draft answers, reports and statements to questions and/or other correspondence received as a result of the proposed rules; and (6) Assist with organizing and updating the rulemaking docket.

Examples of specialized experience will include the following: (1) Conduct continuous reviews of existing standards and regulations to identify those that need to be updated; (2) Draft policy reports and statements, and background information and other preamble language for proposed rulemakings; (3) Review Agency policy statements to ensure consistency with Agency goals and objectives; (4) Review Agency rulemakings to ensure all legal requirements are met; (5) Review and analyze comments received on proposed regulations and determine, in conjunction with senior OSRV staff, program personnel, and the Office of the Solicitor, if issues raised by commenters have sufficient merit to warrant changes in the proposed regulation; (6) Work to resolve any policy issues raised during the rulemaking process and to ensure that the resolution of all policy issues meet the Agency's goals and objectives; and (7) Ensure rulemaking docket is organized and updated.

There is no substitution of education for the required specialized experience for the GS-12 and GS-13 level.
