As Deputy Tax Legislative Counsel, the incumbent is a deputy to, and works closely with, the Tax Legislative Counsel in developing and formulating Treasury Regulations and other Internal Revenue Service (IRS) administrative guidance interpreting current law. The incumbent works closely with senior IRS officials and staff to ensure that Federal tax policies are appropriately reflected in the Treasury Regulations and associated administrative guidance.

In addition to the general duties as a senior attorney in the Office, the Deputy Tax Legislative Counsel has particular responsibility for the following principal duties:

Administrative Guidance Development: Under the general direction of the Tax Legislative Counsel, supervises staff work regarding administrative guidance projects and implementation of the Priority Guidance Plan. Assists in the Tax Legislative Counsel's review and revision of administrative guidance projects, including regulations and revenue rulings and other published guidance, to ensure the Department's policies are incorporated into such guidance. Provides legal analysis, and assists in the Tax Legislative Counsel's analysis of tax law and regulations and makes recommendations for revisions to reflect the Department's policies. Presents and promotes the Department's administrative guidance projects to the Congress, general public, and tax practitioners.

Administrative Guidance Liaison and Coordination: Coordinates the Office's work with regard to administrative guidance projects. Maintains liaison with senior officials in the IRS, including the Commissioner's Office and the Office of Chief Counsel, to clarify legal and policy issues and explain the Department's policy positions. In conjunction with liaison in the IRS Office of Chief Counsel, IRS Associate Chief Counsels and their Deputies, coordinates staff level interaction between the Office and the IRS on regulations and guidance issues. Attends meetings with senior officials of the Treasury and other agencies, staff of Congressional Committees, State and local governments, taxpayer and bar associations and interest groups, and interested taxpayers and tax practitioners to ascertain their positions with respect to administrative guidance.

Administrative Guidance Policy: Represents the Office in Tax Policy in Treasury-IRS meetings concerned with the promulgation of tax regulations and other administrative guidance. Ensures that the legal and policy positions of the Assistant Secretary (Tax Policy) are appropriately represented in the development of the Priority Guidance Plan, in meetings with Congressional staff regarding implementation of tax legislation, and in memoranda and correspondence regarding regulatory and administrative guidance. As required, develops testimony and briefings for presentation to the Congress, OMB, CBO, the White House, the IRS, and Departmental officials regarding the Office's administrative guidance projects.

Legislative Policy: Under the general direction of the Tax Legislative Counsel, supervises staff work regarding the Office's legislative proposals and preparation of the Greenbook setting forth the Administration's revenue proposals. Supervises staff work regarding commenting on legislative proposals presented by Members of Congress or their staff, to ensure the Department's policies are taken into account.

Miscellaneous: Prepares analyses, reports, testimony, and other information in support of the Department's legislative agenda, in particular with regard to projects affecting or affected by regulations and other administrative guidance. Assists Counsel in the development and implementation of specific legislative and administrative guidance projects, and monitors and reports to the Tax Legislative Counsel on the status of specific projects. Researches and develops recommendations for improving the Office's operation and performance in promulgation of regulatory and administrative guidance. As a deputy to the Tax Legislative Counsel, in the latter's absence or unavailability, may be called upon to provide temporary leadership for the Office. The General Counsel will designate an Acting Tax Legislative Counsel as circumstances require.

To meet the minimum qualifications for this position, candidates must possess specialized experience at a senior level which demonstrates ability to perform the duties described above; including progressively responsible supervisory or managerial experience demonstrating ability to manage people and resources. Candidates are strongly encouraged to address each Executive Core Qualifications (ECQ's) and Mandatory Technical Qualifications (MTQ's) separately. Candidates who choose not to address both the ECQ's and MTQ's separately will not be disqualified; but must ensure their resume addresses each sufficient for evaluation. EXECUTIVE CORE QUALIFICATIONS (ECQs): The ECQs describe the leadership skills needed to succeed in the Senior Executive Service (SES) and are in addition to the specific mandatory technical qualifications listed below. ECQ 5 - Building Coalitions - The ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals. Competencies: Partnering, political savvy, influencing/negotiating.

MANDATORY TECHNICAL QUALIFICATIONS (MTQs): The MTQs describe the necessary technical knowledge, skills, and competencies needed to successfully perform the duties of this position. Experience must have been at a sufficiently high level of difficulty to show clearly that the candidate possesses the required professional and technical qualifications and core qualification set forth below. MTQ 1- Diversified legal experience dealing with highly complex issues in the field of domestic federal taxation and related matters.

MTQ 2- Knowledge of the legislative and regulatory process, including the administrative guidance process, applicable to the Internal Revenue Code.

MTQ 3 - A comprehensive and in-depth knowledge of federal taxation with specialization in domestic taxation issues such as corporate income taxes, passthroughs, or individual income tax issues, and outstanding ability to analyze benefits issues from a tax policy, economic policy, and general public policy standpoint, including knowledge of the requirements applicable to implementing the TCJA.

MTQ 4 - A comprehensive understanding of the functions of the Office of the Tax Legislative Counsel and its relationship to other offices within Treasury, the Internal Revenue Service and other Federal agencies.

MTQ 5 - Achievement of significant professional recognition and standing within the benefits community. Evidence of outside professional activities, such as publications, speaking engagements, teaching, or substantial contributions to tax associations or similar groups.
