This position is located administratively in the Office of the Chairman of the National Labor Relations Board. The incumbent reports directly to the Chairman and serves all Members of the Board.. Applicant must possess a JD or LL.B. degree and be a member of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. The selectee will be required to provide proof of current bar membership prior to appointment. ALL APPLICANTS must submit proof of successful completion of education requirements. This proof may consist of a law school transcript, copy of diploma from the applicant's law school, or other documentation which provides clear and specific proof of education, such as a current SF-50 demonstrating that the applicant is currently occupying a position in the 905 series. Education completed in foreign colleges or universities may be used to meet the requirements for this position if you can show that the foreign education is comparable to that received in an accredited educational institution in the United States. It is the responsibility of the applicant to provide such evidence by the closing date of the announcement.. The incumbent will be responsible for the following duties:. Serves as Special Advisor to the Chairman, to whom the office is attached, with respect to all assigned representation matters, and as confidential legal advisor to all Members of the Board who are on the panel in any given case. In such capacity, he advises with respect to the issues in individual cases and the formulation of general policy. Such advice often requires extended study and discussion of the legal issues involved, formulation of legal theory, and examination of the effect of a particular proposed decision upon general interpretation of the Act in the light of Congressional intent and upon relations between labor and management generally.. Exercises authority and responsibility for the preparation of decisions, rulings, and orders, subject to approval by the applicable Board Panel or the Board as a whole, on cases which conform to Board policy, principles: and practices, referring to the full Board only those cases which are determined to require consideration of all Board Members.. Responsibly directs and coordinates all of the activities of the Office of Representation Appeals, with full technical and administrative responsibility for the work of the staff.. The incumbent has been delegated maximum responsibility for the administration of the Office of Representation Appeals. Establishes internal procedures relating to priorities and methods for the processing of cases within the Office; and develops or clears for transmittal to the Board proposals for changes in basic policies and procedures governing the review function.. Participates in deliberations at Board meetings at which representation cases of the highest importance are decided.. Renders advisory opinions to the various Regional Directors with respect to substantive and procedural issues in cases pending before them for decision.. Serves as consultant to the Executive Secretary with respect to advice to be rendered by that office to the Regional Directors and the public.. Participates in planning and directs training programs in the field and in Washington for Regional Directors and their staff with respect to representation matters.. Represents the Board in conferences with Regional Directors, held in Washington and in the field, with respect to matters arising under delegation.. Serves together with the Executive Secretary as the Boards' representative in dealing with the General Counsel with respect to matters arising under delegation.. Assists the Board in substantive rule making under the Administrative Procedure Act, advising Regions of changes in representation rules, and providing guidance to both the Board and the Regions as to application of new representation rules.. At the request of the Board, delivers addresses at various public lay and legal meetings with respect to agency representation case proceedings, policies and practices.. Directs projects relating to representation case matters.. Screens and selects, in consultation with the Chairman, candidates for positions as counsel and administrative assistant on the Representation Appeals staff, and advises the Chairman on staffing needs. THIS POSITION IS IN THE SENIOR EXECUTIVE SERVICE (SES): This position is designated as a General position. This position may be filled by a career or non-career appointee. Candidates are not required to have previous SES career service before applying. The selected candidate's executive/managerial qualifications must be certified by the Office of Personnel Management prior to an initial SES career appointment. Positions in the SES are ungraded.. To qualify for this position, you must meet the following requirements:. As a basic requirement for entry into the SES, applicants must provide evidence of progressively responsible leadership experience that is indicative of senior executive level managerial capability and directly related to the skills and abilities outlined under Professional/Technical Qualifications and Executive Core Qualifications. For this position, all candidates must be an active member of the Bar in good standing of any state, District of Columbia, Puerto Rico, or any Territorial Court under the US Constitution.. ALL CANDIDATES MUST FULLY ADDRESS ALL ITEMS UNDER 'TECHNICAL QUALIFICATIONS' TO BE ELIGIBLE FOR CONSIDERATION. Failure to meet the basic qualification requirements and all Professional/Technical and Executive Core Qualification factors automatically eliminate the applicant from further consideration.. A. PROFESSIONAL/TECHNICAL QUALIFICATIONS - PTQs: Candidates must submit a narrative statement specifically to show possession of the Professional/Technical Qualifications (PTQs). Responses should summarize the applicants experience in relation to the PTQs and specific examples of accomplishments. Total length of narratives should not exceed 3 pages.. 1. Demonstrated expert knowledge of the National Labor Relations Act (NLRA), as amended, Administrative Procedure Act, Federal and State laws affecting the administration of the NLRA or pertaining to the field of labor-management relations; comprehensive knowledge of Board and Office of General Counsel policy, procedures, functions and organization, Board and Court decisions, rules of practice in Federal Courts; and a comprehensive knowledge of the field of labor relations including industrial and labor practices and procedures and labor management organizations. 2. Exemplary analytic and writing abilities; outstanding ability to evaluate the evidence and assess the importance of legal and policy questions that may arise in the case, and to make decisions relative thereto; and outstanding ability to recognize need for development or revision of policy and to formulate and recommend policy. Extensive experience and knowledge of legal practices and procedures governing hearings and rules of evidence. 3. Expert ability to deal tactfully and effectively with Federal officials at the highest policy level, labor and management groups, and the general public; and strong collaboration and problem solving skills. 4. Demonstrated strong leadership ability in directing, supervising, and evaluating the activities of a significant organizational unit (including recruitment, selection, performance management, and imposition of disciplinary actions as necessary); ability to manage a staff many of whom telecommute up to three days a week. 5. Demonstrated ability to interface with a complex electronic case management system.. B.
