Incumbent serves as a Supervisory Attorney Advisor performing the following duties:
  • Serves as a supervisor for a pool of field office attorneys, paralegals, or legal assistants, who, based on a matrix system, support multiple Administrative Law Judges (ALJs) on a case-by-case basis.
  • Supports the management and development of professional staff providing legal services to ALJs and their teams.
  • Reviews case facts and issues within the context of OMHA practice standards, including the nature and complexity of the legal issues arising from case facts as presented by the appellant.
  • Performs duties related to on-the-record (OTR) decision drafting, Settlement Conference Facilitation, and other backlog reduction efforts.
  • Identifies critical, unusual, or emerging Medicare program legal issues, which require additional policy, practice, or procedural guidance.

    Minimum Qualification Criteria for Attorneys:

    EDUCATION:
    Successful completion of a full course of study in a school of law accredited by the American Bar Association through which you have attained the first professional law degree, i.e. LLB, or J.D.

Unofficial transcripts (including screen-prints from your school's web portal) are acceptable for initial application; however the unofficial transcript must show your name, the name of the educational institution, the degree awarded, and the conferred/awarded date.     BAR MEMBERSHIP: All attorney positions require current active bar membership. Admission to the bar of any State, territory, Commonwealth of Puerto Rico, District of Columbia, or Federal Court is acceptable. Employees must maintain active bar membership while employed as an attorney with HHS/OMHA.

    NOTE: You MUST provide proof that you are authorized to practice law. Such proof can include a current active bar card, a screen print from a bar website that reflects you are an active member of the bar or a letter/certificate from the bar certifying that you are licensed and authorized to practice law. Proof (bar card, screen print, letter/certificate) must be dated within one year of the announcement. If using a screen print, make sure it is clear what date the screen print was taken.

    Grade Specific Qualifications:
    In addition to the minimum qualifications above, for the GS-13 Supervisory Attorney Advisor position, candidates must have two (2) years of professional legal experience after admission to the bar with one year commensurate with the duties of the position and at least one year of experience is equivalent to the GS-12 grade level in the Federal service.

    Documenting experience: In accordance with Office of Personnel Management policy, federal employees are assumed to have gained experience by performing duties and responsibilities appropriate for their official series and grade level as described in their position description. Experience that would not normally be part of the employee's position is creditable, however, when documented by satisfactory evidence, such as a signed memorandum from the employee's supervisor or an SF-50 or SF-52 documenting an official detail or other official assignment. The documentation must indicate whether the duties were performed full time or, if part time, the "percentage of times" the other duties were performed. It is expected that this documentation is included in the employee's official personnel record. In order to receive credit for experience in your resume that is not within the official series and grade level of your official position, you must provide a copy of the appropriate documentation of such experience as indicated above.

    Experience refers to paid and unpaid experience, including volunteer work done through national Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; community; student; social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to gain employment. You will receive credit for all qualifying experience, including volunteer experience. If such experience is on a part-time basis, you must provide the average number of hours worked per week as well as the beginning and ending dates of the experience so it can be fully credited.
