Summary

This position is located in the Department of Homeland Security (DHS), Office of the General Counsel (OGC),Technology Programs Law Division (TPLD).

The primary purpose of this position is to serve the Office of the General Counsel as a legal advisor. The individual will serve as a program attorney for various legal matters for DHS's Science and Technology Directorate (S & T).

Responsibilities

The individual selected for this position will be responsible providing legal advicefor government contracts, inter-agency acquisitions, and grants entered into by S&T in the areas ofresearch, development, test, and evaluation. S&T's contracts are issued in accordance with theFederal Acquisition Regulation ("FAR") or DHS's Other Transaction Agreement authority and relate toa broad portfolio of S&T programs, including cybersecurity and biosecurity.

As a Attorney-Advisor (General) GS 0905 14/15, your typical work assignments may include the following under supervision:

As an Attorney Advisor you will:
  • Provide legal advice to contracting officers, program managers, and senior officials concerning the laws applicable to all phases of the research and development contracting process, including acquisition planning, solicitation and award, contract administration, and the resolution of bid protests/disputes.
  • Provide legal advice in the development and negotiation of innovative and R&D centric solicitation and award instruments (e.g., Other Transaction Agreements with consortia, contracts under S&T's Small Business Innovation Research Program, and Partnership Intermediary Agreements).
  • Provide legal advice to grants officers, program managers, and senior officials concerning the laws applicable to all phases of the research and development grants process, including solicitation and award, grants administration, and the resolution of disputes.
  • Participate as counsel on source selections; provide oral and written advice on pre-award procurement issues such as the adequacy of solicitations sole source awards, mistake in bids, agency protests, and bid protests filed before the Government Accountability Office (GAO) and the U.S. Court of Federal Claims.
  • Represent DHS in contract appeals filed before the Civilian Board of Contract Appeals (CBCA), and assist the Department of Justice when appeals are filed before the United States Court of Federal Claims or the Court of Appeals for the Federal Circuit.
  • Provide legal advice for the full range of issues arising in the fields of research and development contracting, acquisition, grants, procurement, and prize competitions, including intellectual property, technical data, claims, bid protests/disputes, fiscal law, information security, protection of governmental rights and property, privacy, environmental issues and other related areas which arise in furtherance of and in connection with the mission of S&T.
  • Possess the ability to be persuasive and, as necessary, persistent with senior executive clients while deftly balancing the most sensitive political, operational support, and situational ramifications.
  • Program attorney to support the general S&T mission.
  • Willingness to advise on legal matters to include general law and administrative law matters including, but not limited to, fiscal law issues, generation of legal memoranda on issues of first impression, legal issues arising from S&T's laboratory operations, and legal issues generated by the Office of SAFETY Act Implementation.
  • Work collaboratively and coordinate within the OGC enterprise, including component counsel offices, as well as with counsel from sister federal agencies, as appropriate.

Qualifications

Basic Requirements:
GS-14 or GS-15:
1. The first professional law degree (LL.B. or JD); or
2. The second professional law degree (LL.M.) AND
3. Specialized professional legal experience in excess of three (3) years that is commensurate with the duties and responsibilities of the position. The quality of the individual's background may be evidenced by the relatedness of his or her specialization.

Specialized Experience:
The Office of the General Counsel (OGC) will evaluate eligible candidates based on the following criteria:
OGC will rate qualified applicants by comparing each candidate's qualifications to those pertinent to the position. OGC will consider relevant skills and experience, education and training, performance, and awards. The skills and experience listed immediately below are of particular importance to the position, and applicants should provide specific detailed information in these areas, where applicable, as part of their application.

To qualify for this position, you must possess one year of specialized experience, equivalent to the GS-13 to grade level to qualify for the GS-14 grade level or GS-14 level to qualify for the GS-15 grade level in the Federal government. Specialized experience is experience providing legal advice and support on matters related to federal acquisition and procurement issues and/or experience providing legal advice and support on matters related to cyber-security, acquisition, and procurement issues.

Substitution of education in lieu of specialized experience may not be used for this grade level.

In addition to the minimum qualifications described above, you must meet the following requirement(s) to be considered qualified for the position:

Current General Schedule (GS) federal employees, and those that have served in GS positions within the last 52 weeks, must have served 52 weeks at the next lower grade, or a combination of the next lower grade level and an equivalent band in the federal service.

Selectee may be required to serve a two-year trial period
Selectee will be required to complete an OGE 450, Confidential Financial Disclosure Form.
Permanent Change of Duty Station (PCS) Expenses will not be paid.

Applicants must be a graduate of a school of law school accredited by the American Bar Association and an active member in good standing of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. If qualifying based on your education, you must submit a copy of your law school transcript OR a list of college courses with credit hours, dates completed, and grades received to verify education. Unofficial transcripts will be accepted. Official transcripts will be required if you are selected for the position.
