Summary

Represents the Agency in class action, collective action, multi-plaintiff, and complex employment litigation matters in federal court and before administrative tribunals. Reports to the Deputy Assistant Chief Counsel for Employment and Labor Law.

Responsibilities

Handles all aspects of class action, collective action, multi-plaintiff, and complex employment litigation matters including class certification, class decertification/modification, discovery, motion practice, trial, and appeal.

Drafts pleadings, motions, briefs, appeals, and any other written documents related to the defense of class action, collective action, multi-plaintiff, and complex litigation matters.

Interacts routinely with high-level agency management officials including high-level regional, center, service area, and headquarters managers to provide expert legal advice and strategy regarding class action, collective action, multi-plaintiff, and complex employment litigation matters including settlement options.

Provides advice and counsel to Agency leadership in anticipation of future class action, collective action, multi-plaintiff, and complex employment litigation matters. Provides advice on any impact to class action, collective action, multi-plaintiff, and complex employment litigation matters.

Represents the Agency in employment and labor law matters before the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), and other administrative fora; and, in conjunction with the Department of Justice and US Attorney's Offices, in federal courts.

Assesses the need for outside counsel to support FAA class action, collective action, multi-plaintiff, and complex employment litigation matters.

Manages complex and difficult legal questions or factual issues that may require original and creative legal thinking to resolve.

In a non-supervisory capacity, mentors a team of attorneys who assist in class action, collective action, multi-plaintiff, and complex employment litigation matters.

Works independently and has broad discretion to ensure alignment with organizational objectives and policies. Establishes and maintains a high level of trust with executive-level management of the Office of the Chief Counsel, agency executives, senior managers or officials of the FAA, the DOT, and other federal agencies.

Performs other duties as assigned.

Qualifications

To qualify for this position, ALL applicants MUST meet the following criteria:

(1) have a JD Degree from an accredited law school;

(2) be admitted to practice before the bar of any U.S. jurisdiction or within the District of Columbia;

(3) be an active member of that bar; AND

(4) demonstrate at least 52 weeks of specialized experience equivalent to the next lower grade/pay band (FG/GS-13/FV-I) in the Federal Government or non-Federal equivalent in the work to be performed at the next lower level for this job series. Specialized experience is defined as that which has equipped the applicant with the particular knowledge, skills, and abilities required to successfully perform the duties of the position, and is typically in or directly related to the line of work of the position to be filled.

SPECIALIZED EXPERIENCE is defined as:
  • working on class action or multi-plaintiff matters;
  • preparing, defending, and deposing expert witnesses; and
  • litigating the issue of class certification.

4) Salary Ranges:
  • Washington, DC: $103,447 - $159,907 (includes 29.32% locality pay for the Washington, DC metropolitan area)
  • Des Plaines, IL: $102,134 - $158,336 (includes 28.05% locality pay for the Chicago, IL metropolitan area)
