Responsibilities

The Division of Investment Management's Rulemaking Office is seeking to fill two Attorney-Adviser positions in the Investment Adviser Regulation Branch of the Investment Adviser Regulation Office in Washington, DC.

Duties:
As an attorney-adviser in the Division of Investment Management's Investment Adviser Regulation Office, your work assignments may include any of the following tasks:
  • Analyze policy and regulatory issues under the federal securities laws as they relate to the regulation of investment advisers;
  • Prepare recommendations for rulemakings under the Investment Advisers Act;
  • Draft substantive legal documents including draft releases and memoranda explaining proposed and final rulemaking initiatives, federal register notices and memoranda;
  • Research, analyze and develop rule text to implement regulatory initiatives;
  • Consult and coordinate with staff across the Division and Commission and public and industry representatives regarding regulatory policy;
  • Provide interpretive guidance to other offices within the Division and to other Divisions and Offices at the Commission (including Regional Offices) on the Investment Advisers Act;
  • Respond to public inquiries; and
  • Assist the Division's senior staff with the preparation of speeches and public presentations.

Qualifications

All qualification requirements must be met by the closing date of this announcement.

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education.

BASIC REQUIREMENT: All applicants must possess the following
  • J.D. or LL.B. degree --AND--
  • Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.
  • SK-13: Applicants must have two (2) years post J.D. experience as a practicing attorney, one (1) year of which includes: providing legal interpretation of Federal securities laws, statutes, rules and regulations, particularly those related to the Investment Advisers Act of 1940.
  • SK-14: Applicant must have four year(s) of post J.D. work experience as a practicing attorney, three year(s) of which includes: providing advice on issues and policies related to Federal securities laws, statutes, rules and regulations, particularly those related to the Investment Adviser Act of 1940. Experience must include conducting reviews and analysis of the most complex issues to assure legal adequacy, sufficiency, soundness of action recommended or taken.

How You Will Be Evaluated

You will be evaluated for this job based on how well you meet the qualifications above.

In addition to the competencies listed above, you will also be evaluated on either one of the following:
  • Private Funds: Experience with the operations and regulation of investment advisers. Including, in particular, experience with the laws and rules concerning the formation, management, and operations of private funds and their investment advisers.
  • Fintech: Experience with the operations and regulation of investment advisers, including experience related to financial technology ("fintech") issues such as blockchain technologies, digital assets, cybersecurity, and the provision of automated investment advice (i.e., "robo-advisers") and other mobile banking and investing services.
