Summary

This position serves as an Attorney Advisor in the Office of General Counsel, reporting to the Associate General Counsel, General Law Practice Group. Performs legal counsel functions across all offices of OGC and NASA advising senior management on complex and difficult legal and policy issues confronting the agency in areas of fiscal law and appropriations law.

Responsibilities

  • Serve as an expert in the substantive law of fiscal and appropriations law, providing advice on a variety of matters, including, budget development, budget execution, fiscal policy, the crafting and interpretation of appropriations laws.
  • Manages, shapes, and executes the Fiscal Law and Appropriations Group (FLAG) community of practice, a group of fiscal lawyers from across the Agency.
  • Provides expert consultative services to fiscal attorneys across the Agency, and trains and mentors fiscal attorneys as well as a variety of client groups across the Agency.
  • Applies expert knowledge and consultative skills to assess vulnerabilities associated with U.S. Government fiscal requirements, including but not limited to legal and reputational risk.
  • Provides personal expertise on solving problems, mitigating risks, and allocating resources with regard to fiscal law.
  • Incorporates expert knowledge of fiscal law, NASA's organic legal authorities, and transferable best practices from other organizations and industries to render advice supporting NASA's overall enterprise risk management.
  • Represents NASA to U.S. Government entities and other organizations on fiscal law matters, including the Office of Management and Budget (OMB), the U.S. Government Accountability Office (GAO), and other federal departments and agencies.
  • Occasionally provides support in other areas of law which may include government ethics, FOIA, employment law, or other areas within the General Law Practice Group.

Qualifications

Applicants must have professional legal experience in excess of two years as is commensurate with the duties and responsibilities of the position being filled. The number of years of experience and level of expertise practicing the relevant areas of law will be considered in determining the grade level.

Professional experience includes providing expert advice on legal and factual issues on fiscal law. Providing legal advice on budget matters and legislation, including agency appropriations, continuing resolutions, and authorization legislation. Analyzing legal authority for funding programs based on legislative language, conference committee reports and executive branch policy directives. Analyzing and providing advice relating to Anti-Deficiency Act questions and investigations. Preparing legal interpretations of statutes, federal regulations and agency directives applicable to programs, projects and agency directorates.

At the full performance level, this position will serve as a primary advocate and legal counsel for a broad range of overlapping areas of law assigned to the Office of General Counsel. Develops a particular expertise on fiscal law and appropriations law with minimal oversight. Other legal assignments include expert knowledge in government ethics, FOIA, employment law, or other areas within the General Law Practice Group. Writes opinions beyond routine requirements but identifies what issues need to be addressed in a preventative manner. Performs as an expert in fiscal law and appropriations and a contributor to this field of expertise as measured by quality of work product, ability to mentor others in this field of law, and ability to provide strategic input to agency leaders to address agency priorities as related to fiscal and appropriations law matters. Personal contacts with very senior leadership is substantive on issues of high sensitivity such as Agency budget priorities.

Education

EDUCATION/BAR MEMBERSHIP REQUIRED: Applicants for attorney positions must possess a professional law degree (Juris Doctorate) from an ABA-accredited school and have admission to the Bar.

Bar Membership: An applicant must be a member in good standing (as defined by the pertinent Bar) of a State, Territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico and be admitted to practice before a state or federal court.
