The incumbent of this position serves as an Assistant General Counsel for the Committee for Purchase from People Who Are Blind or Severely Disabled, with emphasis on the agency's regulatory program. The incumbent also serves as the Alternate DAEO.

Responsibilities

As an Assistant General Counsel, the incumbent performs specialized and complex legal tasks and assignments involving the review and research of questions and issues arising from the implementation of the Javits-Wagner-O-Day (JWOD) Act (41 U.S.C. Chapter 85), which requires a high order of original and creative legal endeavor in order to obtain a reasonable balance of conflicting public and private interest. Legislative drafting and review of proposed legislation impacting the AbilityOne Program by competing procurement priorities among the various preferred procurement sources. Legal review and research duties and responsibilities carried out by the incumbent are of significant importance to the operations and program objectives of the Committee and are typified by the following examples:
  • Prepares legal opinions and reports analyzing questions and issues concerning Committee actions and related regulations, policies and procedures which provide the precedents and bases for legal conclusions and recommendations. Presents findings to Executive staff and members of the Committee; orally and in writing as dictated by the circumstances or the assignment.
  • Prepares and presents the Committee's Semi-annual Regulatory Agenda and drafts proposed rules and regulations relating to Committee responsibilities and operations; serves as the Committee staff focal point and expert on rulemaking matters.
  • Reviews Committee policies, procedures, regulations, technical manuals, and other agency publications to ensure conformance to legal requirements of governing legislation and other pertinent legal criteria and proposes new and revised policies and procedures directed toward improving the Committee's legal position.

Major Duties, continued:
  • Prepares and/or presents the Committee's legal position in an administrative hearing, before a court of original jurisdiction or Appellate court. In cases involving the Department of Justice (DOJ), incumbent assists and gives technical guidance to DOJ attorneys in preparation of the Committee's position and at trial.
  • Advises the Committee on contracting methods and individual contracts. Provides legal advice and assistance in the formulation and administration of contracts and related matters, including contract drafting.
  • Prepares written and oral presentations of the results of such research, including its legal ramifications.
  • Prepares and recommends draft decisions on Freedom of Information Act (FOIA) requests for the Committee's FOIA Officer and makes legal determinations regarding requests under the FOIA. Advises Committee staff on Privacy Act matters to ensure that policies, systems, and procedures are in compliance with all applicable statutes and regulations.
  • Additional responsibilities include other matters as assigned by the General Counsel.

Qualifications

To qualify for the GS-14 Assistant General Counsel, you must have at least one year (52 weeks) of specialized experience equivalent in complexity to the GS-13 grade level in the Federal Service or specialized experience in the Private Sector with a complexity level equivalent to the GS-13 or 14 grade level.

Education

Applicants must be a graduate of a law school accredited by the American Bar Association and be a member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.

Applications will be reviewed and evaluated according to job responsibilities and qualifications as stated:
  • In-depth knowledge of and demonstrated experience with Federal Government organization and operations, Federal administration law, and knowledge and experience of Federal procurement law, the Federal Acquisition Regulation (FAR) and other relevant regulations and policies; including contracts, grants, cooperative agreements and other transactions; Contract Disputes Act procedures, alternative dispute resolution (ADR), and actions before the Board of Contract Appeals, U.S. Court of Federal Claims and court of Appeals for the Federal Circuit, and bid protest procedures before the Government Accountability Office.
  • Experience in conducting and directing complex legal research, engaging in sophisticated legal analysis and presenting the results in a clear, precise and persuasive manner, both orally and in writing, including Federal Government Ethics matters.
  • Demonstrated experience with Federal litigation as counsel to a Federal agency litigation defendant.
  • Skill in drafting and reviewing regulations, letters, memoranda, legal opinions, and court filings, often under extreme time pressure.
  • Ability to translate sound legal advice into effective policy and program options that enable the agency to accomplish its goals.
  • Experience with and ability to direct a small agency staff for Freedom of Information Act and Government Ethics functions.
  • THE FOLLOWING ARE NOT REQUIRED BUT ARE HIGHLY DESIRABLE FOR CANDIDATES TO POSSES:
    • FAMILIARITY WITH THE ORGANIZATION AND LEGAL FUNCTIONS OF THE Committee.
    • Knowledge or familiarity with current Federal disability, rehabilitation, and employment law.
