The Office of Personnel Management (OPM) has not issued qualification standards for patent attorney positions. However, the agency sets minimum qualifications for patent attorney positions and sets forth these qualifications in each vacancy announcement. You must meet all eligibility and qualifications requirements by the closing date of the job announcement.
To be eligible for this position, you must meet the key requirement listed above, and the education requirements to include the following:
1. Have at least four (4) years of post J.D. professional experience, including judicial clerkship(s), in the area of patent litigation. Patent litigation includes federal district court patent cases, patent appeals to the U.S. Court of Appeals for the Federal Circuit, and trial proceedings in patent cases before the International Trade Commission and the USPTO’s Patent Trial and Appeal Board. The ideal candidate also has professional experience and substantive knowledge in the area of trademark and/or copyright law.
2. Have at least one (1) year of specialized experience equivalent to the next lower (GS-14) grade level in the Federal service. Specialized experience is defined as (i) primary drafting responsibility for briefs, memos, and legal opinions in the area of patent law; and (ii) independently conducting legal research and preparing written analyses of complex and difficult legal, factual, or policy issues in the area of patent law.
Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
Education requirements: possess both (i) a technical degree in a scientific/engineering discipline from an accredited college or university; and (ii) a Juris Doctor (J.D.) degree or Master of Laws (L.L.M) degree from an American Bar Association accredited law school.

Trial Period- If selected, you may be required to complete an initial two-year trial period.
