Chief IP Counsel
Danaher's corporate headquarters are located in Washington, DC, but with its business and operating business leaders positioned globally. The operational legal staffs are located with the business units and the IP legal function is part of those teams. The Chief IP Counsel reports directly to the Senior Vice President & General Counsel, and will provide legal advice, counsel, and services to ensure that Danaher is protecting its innovations, while respecting the intellectual property rights of others. Primary responsibilities include leading the IP efforts of Danaher in support of Danaher's strategic business interests and technology developments, establishing DHR Corporate IP legal policies and procedures for its in-house counsel, supervising IP legal due diligence for Danaher's mergers and acquisitions at both strategic and execution levels, and oversight of DHR's IP litigation matters. The Chief IP Counsel will have global responsibility and extensive interaction with the Danaher corporate Strategic Development, Corporate Development and Business Development teams as well as with Danaher's operating company IP legal and technology teams, in developing and implementing Danaher's acquisition, product development and long-term innovation programs., In addition to those identified above, other duties may be assigned as follows: * Partner with Corporate Strategic Development and operating company leadership to develop business strategy based on IP landscapes and competitive IP assessments. * Drive a shift from defensive to offensive IP strategy proprietary and foresighted insight. * Partner with operating company presidents to elevate DHR in-house IP counsel and integrate them into Leadership team decision making. * Develop and deploy novel high value tools to integrate IP into strategic planning, technology roadmapping, product development and open innovation. * Provides counsel, direction, policy and procedures for identifying Danaher's commercially significant IP developments and for cost effectively protecting them. * Provides training materials and programs for Danaher in-house counsel to keep current in relevant changes in IP law. * Identifies best-practices in use at the various operating companies and share them throughout the company. * Assists in the selection of new in-house IP counsel of strong competence and character; * Negotiates enterprise-wide contracts with IP legal service providers for high quality with reduced costs. * Collaborates with in-house and outside counsel in the early analysis of defensive IP litigation matters and disputes to establish a strategy for a timely and cost-effective resolution. * Review offensive litigation prior to filing to confirm alignment with Danaher's business purposes and that a cost-effective plan for the management of the litigation is in place., The position will be based in Danaher corporate offices in Washington, DC. Travel Travel required based on business needs, particularly in the early years when learning Danaher's world-wide business operations. * Demonstrated business acumen, strong analytical skills, and the ability to grasp important business issues and legal issues facing the Company * Approaches IP with a strategic mindset by anticipating future business, competitive and legal risks and looking for creative solutions and opportunities. * Champions continuous improvement and regularly seeks out opportunities to drive greater efficiency in core work processes. * Strong communication and presentation skills for reducing complex IP legal matters down to understandable business issues for decision by Danaher's business leaders. * Demonstrated ability to interact effectively with senior business leaders and legal counsel to successfully identify, develop and execute strategic IP efforts. * Passion for working with operating companies as a team member that helps us win in the product, talent and innovation markets * Must be capable of working independently with limited administrative support, and as part of various ad hoc and established teams, with different roles and responsibilities depending on the team. * Ability to prioritize issues and manage multiple projects at a time. * Demonstrate high integrity and ethics in all dealings, non-political in conduct, while understanding internal and external dynamics, * A minimum of 15 years of experience practicing IP law with a law firm, with additional corporate experience preferred. * JD required, along with a Bachelor's degree in engineering or life science * Must have significant patent litigation and mergers/acquisition experience, with experience in IP strategy in a corporate environment being a plus. * Relevant industry experience (eg, medical device, life science, etc.), with experience in highly regulated environments being a plus. * Experience managing complex legal and intellectual property issues. * Ability to work across functions (including, R&D, Finance, HR, Operations and M&A), cultures and organizational hierarchy. Language Skills English fluency required. Additional language skills are beneficial.
